He explained the <br /> proposed project is to raze the existing single family dwelling and construct a new single <br /> family dwelling, the installation of a title 5 sewage disposal system in the front yard, a <br /> rinse station, covered entry, porch, wooden platform with steps, stone drive retaining <br /> wall and grading and landscaping. They have applied to the Board of Health and they <br /> have approved the project. Construction includes drywells and downspouts. Mr. Costa <br /> reviewed the proposed project on the photos provided. The project meets the <br /> performance standards. <br /> The Agent recommended a Close and Issue. <br /> No comments from the public. <br /> Motion: Mr. Sweet moved to Close and Issue, seconded by Mr. Smith. 6-0 <br /> 6:98 Jeremy N. & Farhana R. NOI <br /> Commissioner Thomas O'Neill recused himself due to a possible conflict of <br /> interest. <br /> Resource Area: LSCSF, Buffer Zone to BVW, Salt Marsh, Land Under Ocean <br /> Matt Costa, Cape & Island Engineering, represented the applicants. He explained the <br /> proposed project consists of removing a portion of the existing patio and the installation <br /> of a lap swimming pool, a spa, altering of the existing landscape steps, removing a <br /> portion of the existing lawn and installing mitigation plantings. A waiver is being <br /> requested for the construction of a portion of the proposed pool and spa area within fifty <br /> feet of a wetland resource area. The proposed pool and spa are located within existing <br /> patio and lawn area. The area moving closer to the wetland includes the proposed pool <br /> and spa. The proposed mitigation plantings will be located in the existing lawn area and <br /> the total amount of mitigation plantings exceeds the required amount of mitigation. Mr. <br /> Costa explained the need for the pool is minimally compelling due to the unique size of <br /> the property. The degree of variance from the standards is minor because the proposed <br /> structure will be located in a legally previously disturbed area. The degree of <br /> compensatory/mitigating measures is a major due to the proposed long-term mitigating <br /> measures, exceeding the requirements and resulting in increased habitat area. The <br /> project has been designed to satisfy the waiver criteria and balance the three criteria in a <br /> way that results in improving the natural capacity of the regulation resource areas to <br /> protect the wetland values. He said they are going to agree with the Agent's <br /> recommendation to relocate some of the plantings. He will submit a revised plan of the <br /> relocation of these plants. <br /> 5 <br />
