f
f
6. Bond for septic system: Main Street village Association.
Glen Harrington stated that in 2005 The Main street Village septic system was approved with the condition that
financial assurance must be provided in the form of an insurance bond for the recommended amount of
$50,000. That bond was provided but expired in 2010.
Brian Baumgaertel made a notion that the Board of Health require the insurance bond for maintenance of the
shared septic system for Main Street village at 334 Main Street to be increased from $50,000 to $100,000 in
the event of a failure or maintenance required on the system, the bond is to be renewed annually, and proof is
to be submitted to the Beard of Health.
OLD BUSINESS
1. Release of Condemnation: Unit.## , Riverbend Motel, 100 Great Neck Road North.
Glen Harrington commented that veronica Warden performed a follow-up inspection at Unit#3, 100 Great
Neck Road North, I iverbend Motel, and observed that the unit had been cleaned. The exterior walls still
needed some work. However, since the weather has prevented the repairs} more time was allowed to
complete the work.
Brian Baumgaertel made a motion that the Board of Health release the condemnation order for Unit#3,
F iverbend Motel at 100 Great Neck Load North. l alliope Bgloff seconded the motion. The motion was
unanimously approved.
2= sanitary code violation: Deer crossing condominium Unit U-137.
Glen Harrington stated that the Board of Health has been involved.with Unit U--1 37, Geer crossing
Condominium, for 7 months and progress has stopped. The kitchen has become more cluttered, and clothes
and materials are being moved to the second floor and basement against the direction of the Assistant Health
Agent. Ms. Ballard is very manipulative towards the Assistant Health Agent and the case worker, Susan Hood.
As the Assistant Health Agent tries to impress upon the owner the importance of removing the items, the
owner rakes more excuses. Recently, she had her pulmonary doctor and primary care doctor contact the
Board of Health.
The email from the Fire Department in March only supports the lack of attention and respect that the owner
has towards the orders to declutter her unit. The liability to the town is increasing as the violations are still not
abated. The emergency personnel cannot get into the unit effectively, and the secondary egress is stili
blocked.
Ir. Harrington recommended to give the occupant 30 days to comply on her own with the following conditions:
1. Abate the hazards as outlined in the notice of September 20, 2016 which was the initial order letter.
. A discussion is needed to determine if moving the clutter to the second floor and basement meet the
criteria for abating the clutter. Description for the first floor habitable space to be returned to "used as
intended".
3. If the owner fails to abate the violations, then the Board will perform the organization and place a lien
on the property.
Mr. Harrington presented photographs of the clutter at Unit U-1 37 Deer Crossing condominium to the Board.
Brian Baumgaertel made a motion that the Board of Health order the occupant to comply with the following
conditions:
1. Abate the hazard as outlined in the notice of September 20, 2016.
. return the habitable space to be used as intended.
. If after 30 days the owner fails to abate the violations, then the Board of Health will perform an
organization and place a lien on the property.
3
