V <br /> Mallory Langler made a motion that the Board of Health approve the proposed septic plan for 13 Spoondrift <br /> Way provided that the tank/pump chamber be sealed to assure water-tightness. Laurel Almquist seconded the <br /> motion. The motion was unanimously approved. <br /> 7:40 FSM —sanitary code violations and Fines —4 Tri-Town Circle. <br /> Glen Harrington stated that on August 3, 2017, a show-cause hearing was held for 4 Tri-Town Circle, and the <br /> owner failed to appear. The Board voted to issue fines for non-compliance, to schedule a hearing to determine <br /> whether the dwelling is unfit for human habitation, and to require the submittal of floor plans. On August 21, <br /> 2017, the owner's representative, Attorney Wall, contacted the Board of Health and requested a hearing to <br /> review the orders issued on August 3, 2017, by the Board. The hearing was scheduled for August 24, 2017t <br /> but a continuance was requested by the owner's representative. on August 29, 2017, Mr. Harrington met with <br /> Attorney Wall and discussed the matter. <br /> Brian wall, Esquire, representing Richard Halpern owner of 4 Tri-Town circle, introduced himself to the Board. <br /> Attorney Wall stated that Richard Halpern purchased 4 Tri-Town circle in 1985. Auer several complaints were <br /> filed with the Board of Health, the Health Agent conducted an inspection and discovered a number of sanitary <br /> code violations and septic issues. A list of the violations, followed by a letter, were sent to Mr. Halpern. Mr. <br /> Halpern responded to that by correcting all of the sanitary code violations. As required, he hired a septic <br /> inspector to conduct an inspection. The Board of Health issued a letter dated March 13} 2017, stating that an <br /> engineer was to be hired within 14 days and to submit a plan for the Board's approval for replacement of the <br /> two septic systems. Within 45 days of plan approval, installation of the septic system was required. At that time <br /> there was a miscommunication between Mr. Halpern and the septic inspector. Mr. Halpern understood that he <br /> had two gears to repair the failed systems. He was also unaware of the show cause hearing scheduled on <br /> August 3, 2017, <br /> When Attorney Wall met with Glen Harrington to try to correc#.the situation, Mr. Harrington informed Attorney <br /> Wall that Mr. Halpern should hire an engineer and submit floor plans as the Board had required. Mr. Halpern <br /> hired Blatt Costa of cape & Islands Engineering to prepare a septic system replacement plan that will be <br /> submitted to the Board once is it completed, secondly, Mr. Halpern provided floor plans to Attorney Fall, which <br /> were presented to the Board this evening. Mr. Halpern has a potential buyer as the house has been for sale. <br /> Attorney Wall stated that Mr. Halpern was not ignoring the Board and requests that the Board rescind the fines. <br /> Mr. Harrington remarked that the floor plan sheets for the basement, first floor, and second floor are not <br /> labeled. Attorney Wall stated that he will have the floor plans maned and redistributed. Mr. Harrington <br /> remarked that the property is identified with 3 bedrooms and 5 bedrooms are shown. The Zoning Board of <br /> Appeals determines dwelling units, and the Board of Health verifies the number of bedrooms. Attorney Wall is <br /> requesting a month's time to research information for the number of dwelling units. He also plans to discuss <br /> the engineer's design plan at that time. <br /> Mr. Harrington will also investigate the number of bedrooms by researching the issuance of building permits. <br /> The septic system is to be pumped as needed and checked on a weekly basis so there is no health hazard <br /> caused by a back-up. <br /> Mallory Langler made a motion that the Board of Health allow a 4-week extension on the deadline for the plan <br /> - submission nd..instatlatlon €f.a-new.-septic..system at 4-Tri-Town Circle provided that weekly inspections-of-the _ <br /> septic system are completed and the system is pumped as necessary. Also, the Health Agent is to confirm the <br /> number of bedrooms in the hone. The fines are to be re-affirmed at this time and re-visited at a later date. <br /> Mallory Langler mended the motion that the Board of Health suspend the fines where they are at now, to be <br /> re--visited at the installation of the system. Laurel Almquist seconded the motion. The motion was unanimously <br /> approved. <br /> 4 <br />
