addition, rather than the two-phase purchase anticipated in May, through which <br /> the Town would have purchased 15 acres of upland and 60 acres of marshes, the <br /> entire 325 acre Bufflehead property will be purchased at one time, primarily by <br /> the U. S. Fish & wildlife Service and most likely within the next six months. <br /> Recommendation: The Finance Committee will make a recommendation at <br /> Town Meeting. <br /> Motion to be made by George Costa. <br /> Motion: I move that the Board of Selectmen be authorized to acquire, by <br /> purchase or otherwise, for conservation purposes, a parcel of land, being a <br /> portion of that land shown on a "Plan of Land in Mashpee, Mass. Prepared for <br /> the Bufflehead Bay Nominee Trust," revised date November 6, 1996, by Hayes <br /> Engineering, Inc. of Wakefield, MA, as well as a portion of the land shown on <br /> Land Court Plan 40422A, said land also being portions of those parcels shown on <br /> the 1995 Mashpee Assessors Maps as Map 115, Blocks 1, 6, 7, and 8, generally <br /> located between Upper Great River, Jehu Pond, Abigail's Brook and Great Oak <br /> Road, to be held in the care and custody of the Conservation Commission <br /> pursuant to Massachusetts General Laws Chapter 40, Section 8C; and further, that <br /> $500,000 be appropriated for such purpose, including expenses incidental and <br /> related thereto, and to raise such appropriation, the Treasurer, with the approval <br /> of the Selectmen be authorized to borrow $500,000 under and pursuant to <br /> Chapter 44, Sections 7 and 8C and, if applicable, Chapter 40, Section 8C, of the <br /> General Laws, or any other enabling authority, and to issue bonds or notes of the <br /> Town therefor, provided that no bonds or notes of the Town shall be issued <br /> unless and until grant agreement has been executed between the Town and the <br /> Commonwealth of Massachusetts for reimbursement to the Town in the amount <br /> of at least $250,000 under MGL Chapter 132A, Section 11, or any other <br /> applicable law; and further that $500 be transferred from revenue available for <br /> appropriation to the Issuance of Debt Account; and further that the Board of <br /> Selectmen and/or Conservation Commission be authorized to apply for and accept <br /> Federal and/or State grants, including reimbursement under Chapter 132A, <br /> Section 11 of the General Laws, the "Self-Help Act," to be applied by the Town <br /> toward the financing of this purchase, and to enter into contracts or agreements <br /> with Federal and/or State agencies, private conservation trusts or other entities or <br /> persons in connection with the purchase of such land and its preservation for <br /> conservation purposes; and finally that the Conservation Commission and the <br /> Board of Selectmen be authorized to enter into agreements and execute any and <br /> all instruments as may be necessary on behalf of the Town to effectuate said <br /> acquisition. <br /> 37 <br />
