5 <br /> Board of Selectmen <br /> *DRAFT*Minutes <br /> February 25, 2019 <br /> NEW BUSINESS <br /> Discussion of Open Meeting Law Complaint filed by Ronald Beaty: <br /> The Board of Selectmen was in receipt of an Open Meeting Law Complaint filed by Ronald Beaty of West <br /> Barnstable on February 12, 2019 relative to the meeting conducted by the Board of Selectmen on February <br /> 11, 2019 by posting an insufficient specific meeting notice because said notice did not include the street <br /> address of the venue and/or location where the meeting took place. <br /> In response to the complaint it was the recommendation of the Board of Selectmen to adopt new policies <br /> by reading aloud the new policies and voting as follows; <br /> Motion made by Selectman Sherman to move while there are no Open Meeting Law violations with <br /> respect to how the Town lists the location of meetings on its agendas or how frequently boards <br /> review executive session minutes and release any capable of being released —that the Town adopt the <br /> following three suggestions of the Town Manager: (1)while listing "town hall"without an address <br /> complies with the Open Meeting Law, each agenda going forward will also include the address; and <br /> (2)while town boards currently review executive session minutes for possible release if the reason for <br /> the executive session no longer exists in compliance with the Open Meeting Law,which does not <br /> define "reasonable interval to determine if continued non-disclosure of minutes is warranted," town <br /> boards will from now on review executive session minutes on the even more frequent basis of every 3 <br /> months; and (3) Board members and staff will continue to take the Open Meeting Law training <br /> offered by the Attorney General's Office when they first take office and the Town will continue to <br /> require that all new members or staff take the training annually. <br /> Motion seconded by Selectman Cahalane. <br /> VOTE: Unanimous. 4-0. <br /> Roll Call Vote: <br /> Selectman Sherman,yes Selectman Cahalane,yes Selectman Gottlieb,yes <br /> Selectman O'Hara,yes Opposed, none <br /> Discussion of Proposed Town Meeting Warrant Article— 150th Anniversary Committee; Brian Hyde: <br /> Brian Hyde, a member of the Mashpee 150th Anniversary Committee an ad hoc committee of the Board of <br /> Selectmen requested consideration to place an article on the May Town Meeting warrant to fund the Town <br /> of Mashpee's Sesquicentennial Celebration in 2020. Mashpee 150th Anniversary Committee members in <br /> attendance were Ava Costello, Patricia Keliinui, John Fulone and Sean Eagan. <br /> Mr. Hyde indicated the committee attempted to apply for Community Preservation Act funds, however, the <br /> project was deemed an inappropriate use of CPA funding. <br /> To move forward with this endeavor, a draft May 2019 Town Meeting article was presented to the Board <br /> of Selectmen requesting the Town raise and appropriate or transfer from available funds,the sum of <br /> $179,000, or any other amount,to be expended under the direction of the Mashpee 150th Anniversary <br /> Committee with approval by the Board of Selectmen, for the purpose of funding the Town of Mashpee's <br /> Sesquicentennial Celebration in 2020, or take any other action relative thereto. <br />
