Holmes: "Transaction cards are at the state level correct?"
York: "No, I am talking about at the town level because of the number of violations within the
town of Mashpee. Should we wait for more violations to act on a suspension or to revoke his
permit?"
Richard Cook: "We should assume that this has been occurring for a while now and that past
violations have also occurred. The permit should be suspended. This would send a message to
the other people who are also in violation under the shellfish regulations.
Marques: "The regulations do say that we have that authority as a board."
York: "Yes we can."
Thomas: "Has the Tribe seen missing product on their grant?"
Fisher: "Yes they have been reporting theft over the past couple of years. They have also
witnessed and reported Kenny Thompson in their grant area, as well as the town's transplant area
at Mashpee Neck Landing."
Thomas: "I agree with Cook,we should act on this and suspend or revoke his commercial
permit. The town has been extremely generous by providing seed for future harvest. We have a
good program in this town to help combat the nitrogen loading issue. We have made progress in
other areas. For us not to be actively involved in the enforcement and prosecution or suspension
of people's licenses? It needs to happen and it needs to happen now. Enough is enough."
Marques: "I agree and in the regulations it gives us the authority to do that."
Fisher: "Given his track record in Falmouth, violation after violation is evident, and he has
already caused his family permit to be revoked by the Marine and Environmental Affairs in that
town."
Holmes: "When is this going to hit the media? What is it going to do to the credibility of our
program?"
Fisher: "We are currently unsure as to when and if this will hit the media."
Motion: Thomas made a motion to recommend to the selectman that Kenny Thompson's
Mashpee commercial shellfish permit be suspend until such time the investigation by the
Mashpee Natural Resource Department and the Massachusetts Environmental Police is
complete. Seconded by Christensen, all voted unanimously in favor.
Cook: "Legally he will be able to get a new permit in March at the Clerk's Office."
