Motion: I move the Town vote to approve Article 14 as printed in the Warrant, with the <br /> exception of the phrase "or take any other action relating thereto". <br /> Motion passes at 8:29 PM. <br /> Article 15 <br /> To see if the Town will vote to amend Article V of the General Bylaws by deleting §3-21 in its <br /> entirety. <br /> Submitted by the Board of Selectmen <br /> Explanation: Massachusetts General Law Chapter 60, §77B allows the custodian of tax <br /> possessions (Treasurer) to sell tax foreclosed properties at public auction. Section 3-21 restricts <br /> the disposition or sale of tax foreclosed property until Town Meeting action is taken, restricting <br /> our ability to restore properties to the tax rolls. <br /> The Board of Selectmen recommends approval by a vote of 5-0. <br /> Finance Committee recommends approval by a vote of 7-0. <br /> Motion made and passed to dispense with reading of article at 8:29 PM. <br /> Motion made by Selectman Thomas O'Hara <br /> Motion: I move the Town vote to amend Article V of the General Bylaws by deleting §3-21 in <br /> its entirety. <br /> Motion is defeated at 8:57 PM. <br /> Article 16 <br /> To see if the Town will amend the General Bylaws by incorporating the following sections <br /> requiring that all members of appointed and elected multi-member bodies of the Town be <br /> residents of Mashpee, and to revise the succeeding section references appearing in each <br /> respective Chapter of the General Bylaws to reflect the incorporation of the new sections: <br /> 1) Chapter 3, Article I Miscellaneous Provisions: Add a new §3-1 as follows: <br /> §3-1 Residency Qualification: <br /> All appointees to multi-member boards, commissions, or committees of the Town must be <br /> Mashpee residents as of the date of their appointment and throughout their terms of office; <br /> provided, however, that Town officers or employees designated to serve "ex officio" by virtue of <br /> their office on any such board, commission or committee shall be exempt from this requirement, <br /> and provided, further, that non-resident appointees to multi-member boards, commissions, or <br /> committees holding Town office or employment positions as of the effective date of this <br /> amended Bylaw shall be exempt from this requirement for the remainder of their terms of office <br /> 18 <br />
