Following a discussion, it was agreed the Agent purchase 7 tablets. <br /> Update: AFCEC/Upper Quashnet Restoration Revised Agreement <br /> The Agent stated we are in the final stages of approval for the funding agreement and right <br /> now we are awaiting the approval for our consultant to start work and invoicing. <br /> Update: New Seabury Storm Water Infrastructure. <br /> The Agent gave an update on the New Seabury Storm Water Infrastructure. He said he <br /> provided a link to Brad Sweet to a Storm Water Handbook. This is something that can be <br /> presented at their association meeting and to review all of the options they have. <br /> 91 Edgewater Road — Enforcement Order compliance and new violation. Agent <br /> recommendations for compliance. <br /> The Agent invited Joe Appleman, 91 Edgewater Road to discuss a new violation. He noted <br /> there have been a lot of violations on this property. The Agent stated he went out to the <br /> property recently to look at three trees on the property, two were dead and the other a very <br /> large beach tree in close proximity to the house. Mr. Appleman will be coming forward with a <br /> RDA permit to remove these trees. The Agent stated the other reason we were on the <br /> property is there was a contractor on the property who cut off a limb on a beach tree on the <br /> inland bank with no notification to Conservation. The Agent stated given the past violations, he <br /> would recommend a $300 fine for this violation. The owner said he learned a valuable lesson <br /> and it won't happen again. Following a discussion, the commissioners agreed to fine Mr. <br /> Appleman $150. The Chair asked if the three trees that are dead could be approved on an <br /> administrative approval to remove them. The Agent noted Mr. Appleman had come up with a <br /> mitigation plan and temporary irrigation. We allowed for expansion of a deck and upon <br /> discovery of the violations that deck extension permit was revoked and it was contingent on <br /> him coming back to request a permit for the deck extension once the mitigation was fully in <br /> compliance. The mitigation came with a 3 year monitoring maintenance requirement and we <br /> did have one site visit and everything looked good on the initial inspection but that was it. No <br /> annual reports were submitted from that point on and it is now 3 years later. The Agent <br /> recommended there be one more additional year added on with two more monitoring <br /> requirements, this spring and this fall of 2019. The reports would need to be submitted by a <br /> certified landscaper and if everything looks good the commissioners could revisit the deck <br /> addition request. <br /> Motion: Mr. Cook moved that Mr. Appleman be fined $150 for branch tree removal, the <br /> extension of one-year monitoring for the mitigation plantings and grant administrative <br /> approval for the tree cutting of the 3 dead trees, seconded by Mr. Dalton. Vote <br /> unanimous 4-0 <br />
