recommended setting a limit of 10 marijuana establishment permits, but setting the number of <br /> marijuana retailers as to be determined per the Mashpee by-law. Mr. Harrington stated that <br /> Town Counsel recommended removing the requirement for the board to act on applications <br /> within 60 days, as there was no real basis or requirement for it. <br /> Mr. Harrington stated that language was added to the marijuana establishment operating <br /> requirements requiring a list of current agents,employees, and management be provided to the <br /> Board of Health at time of renewal, as well as copies of any Cannabis Control Commission _ <br /> Inspections. <br /> There was discussion among board members about the required number of inspections per the <br /> state regulation. Mr. Harrington will get clarification. Chair Baumgaertel asked if there was an <br /> inspection criteria, and Mr. Harrington answered that it was forthcoming and training will be <br /> conducted. <br /> In response to Ms. Langler's concerns about establishments not being permitted as food <br /> establishments, Mr. Harrington stated that good management practices and the food code are <br /> Incorporated Into the regulation, and inspections would be performed according to the <br /> requirements within the food code. <br /> Chair Baumgaertel expressed concern about enforcement, specifically Section D.1, and Keeping <br /> marijuana out of the hands of the underage population. Mr. Harrington stated that, if a minor <br /> were to acquire a bag of marijuana that still had the barcoding or tracking device on it,then police <br /> could track where it came from and possibly how it got into the.hands of the minor. Matthew <br /> Stokey, a member of the public audience, Introduced himself to the board and stated his <br /> Interpretation that the regulation is trying to prevent straw purchases, purchases specifically for <br /> transfer to individuals under the age of 21. He commented that It would be best to target <br /> individuals rather than businesses,who have no control over the product once It leaves store. <br /> Robert.Catania,a member of the public audience,introduced himself and stated his concern that <br /> Section E.3.1, may cause problems for manufacturers. He Indicated that selling to wholesalers <br /> would be difficult without the ability to give samples free of charge, a common practice among <br /> manufacturers and wholesalers. Chair Baumgaertel stated that the Intent is to prevent <br /> distributors from giving out free samples to clientele, and indicated that the board would revisit <br /> this matter after Mr. Harrington has had an opportunity get clarification. Mr. Harrington will also <br /> get clarification on tinctures. <br /> There being no further comments or questions, Mallory Langler moved to continue discussion of <br /> the Draft Recreational Marijuana Regulation to the next meeting on March 7, 2019. Motion <br /> seconded by Laurel Almquist, Vote: Unanimous(3-0). <br /> NEW BUSINESS <br /> 1, Approve Board of Health Meeting Minutes. Minutes of the January 24,2019 Public Session were <br /> reviewed without changes. <br /> There being no questions or revisions, Mallory Langler moved to approve the minutes of the <br /> January 24, 2019 Public Session.
