Motion: Mr. Sweet moved to accept at the request of the applicant to continue the hearing to <br /> 7/11/19 at 6:00 p.m. <br /> 6:06 John J. & Catharine J. Brennan, 38 Fiddler Crab Lane. Proposed construction of additions <br /> to existing dwelling. NOI <br /> Resource Area: Land Subject to Coastal Storm Flow, buffer zone to BVW and Salt Marsh <br /> Bob Gray, Sabatia, Inc. represented the applicants. He explained the project site is in New Seabury on <br /> Ockway Bay. The proposal is there will be 4 additions to the existing house. He reviewed the plan that <br /> shows the wetland boundary and the 50 ft setback and the 100 ft. setback. He said on the seaward <br /> side they have a proposed addition but it is going over the existing deck. They will be enclosing the <br /> area below which is presently being used for storage and a 4' deep frost foundation is required. He <br /> .highlighted the oak tree that may need to be pruned and in a worst-case scenario is the tree would <br /> have to be removed. He said at this time he cannot say the frost wall would be detrimental to the tree. <br /> He noted if they find the need to have the tree removed, they would work with staff to determine what <br /> mitigation would be necessary for replacement of the tree. The Agent said because it is a wait and see <br /> approach they could work with the staff at the appropriate time on mitigation. The Agent noted the <br /> Board of Health comments where they checked off no application or review is necessary and to notify <br /> applicant a septic inspection is necessary prior to building permit sign off. <br /> Mr. Gray stated they will be going to the Zoning Board of Appeals at their second meeting in April <br /> No comment from the public <br /> Motion: Mr. Sweet moved to Close and Issue with the condition if there is damage to the oak <br /> tree that the staff would figure out the best way to handle it, seconded by Mr. Dalton. Vote <br /> unanimous 4-0 <br /> 6:09 Michael & Christine Butera, 186 Ninigret Avenue. Proposed installation of privacy fencing <br /> and after the fact permitting of two existing patios. NOI <br /> Resource Area: Buffer zone to Bordering Land Subject to Flooding and Land Under <br /> Waterbodies and Waterways (Johns Pond) <br /> Christine Butera, homeowner was present. Christine described they are proposing to replace old rotted <br /> wood, plastic patio with natural bluestone, set on stone dust and add blue stone to an existing level <br /> backyard, predisturbed area set on stone dust which did not require any removal of vegetation, shrubs <br /> or trees and install a 4-foot privacy fence between houses. She noted the area of where the fence is <br /> proposed to be installed. <br /> The Agent noted the patio areas and noted these were after the fact and no vegetation was removed. <br /> He said there was nothing done to impact the resource areas. He recommended a negative <br /> determination. <br /> No comment from the public <br /> Motion: Mr. Sweet moved a Negative Determination, seconded by Mr. Dalton. Vote 4-0 <br /> 6:12 Julieann E.
