Wayne Tavares, Wet Tech Design, represented the applicant. He reviewed the mitigation plan. He <br /> explained the proposed project includes taking out a portion of the deck and moving it to the other side. <br /> They would also like to use the existing mitigation plantings, prune them, fertilize them once and add <br /> irrigation and supplement the planting. Mr. Tavares stated they are also looking for a waiver to work in <br /> the 50' buffer zone to construct a 10 x 12 utility shed on the property line as well as a maintenance plan <br /> for poison ivy. <br /> The Agent stated he sat down with Wayne and looked at all of the mitigation areas and stated he felt it <br /> was fair mitigation and recommended a Close and Issue. <br /> No comment from the public <br /> Motion: Mr. Sweet moved to Close and Issue, seconded by Mr. Dalton. Proposed reconfiguration of lower and upper decks, <br /> addition of steps, expansion of kitchen and porch areas, and construction of a retaining wall. <br /> NOI <br /> Resource Area: Buffer Zone to BVW, Land Under Waterbodies and Waterways, Inland Bank, <br /> Mashpee Pond <br /> Raul Lizardi-Rivera, Cape and Islands Engineering, represented the applicant: He explained the <br /> project is to remodel the inside and the outside of the house and reconstruct the rear deck and the <br /> expansion of the front porch. There is a proposed retaining wall along the southern side of the walkout <br /> basement level. There are existing landscaping features along the Mashpee Pond side of the property <br /> which was approved under a prior order of conditions. None of the proposed reconstruction work is any <br /> closer to the resources. There is no clearing of vegetation proposed and stated the walkway will be a <br /> pervious surface. He said in the front, the expansion on the house is a kitchen so the kitchen will be <br /> expanded onto the area that is a porch so a new porch will be added. <br /> The Agent noted the limit of work goes along the top of the inland bank so there is no disturbance to the <br /> inland bank. He said Natural Heritage sent a letter indicating a no take exemption status. He said he <br /> did go out to the property to make sure the retaining wall will be done by hand. <br /> No comment from the public <br /> Comments from 3/14/19 Hearing <br /> (Raul Lizardi-Rivera, Cape & Islands Engineering, represented the applicant. None of the proposed modifications of the deck will be any closer to the resource <br /> area. There will be no cutting of trees. In the front, the expansion on the house is a kitchen so the <br /> kitchen will be expanded onto the area that is a porch so a new porch will be added. He noted on the <br /> plan where the proposed retaining will be installed to allow for the lower deck to be one level. He <br /> explained a portion of the work is after the fact work. The proposed work within the 100' buffer to the <br /> inland bank, consists of the removal of the existing upper and lower decks which had to be removed <br /> for safety, reconstruction of the upper and lower decks with stairs, the construction of a retaining wall, <br /> construction and maintenance of an addition to the front portion of the of the residential single family <br /> dwelling, expand the covered porch and associated clearing, grading, utilities and landscaping. <br /> The Agent showed pictures of the property. He noted the limit of work goes along the top of the inland <br /> bank so there is no disturbance to the inland bank. We received the letter from Natural Heritage <br /> indicating a no take exemption status. The Chair suggested specifying the walkway will be a pervious <br /> surface and to make sure the soil on the bank is secure. The Agent stated this could be a condition <br /> placed on the project.) <br />
