Ed Pesce, Pesce Engineering, represented the applicant was present along with Mr. Neil Larrson. He <br /> said they are proposing to replace the aged dock with a new one. The intent is to extend the dock <br /> landward to get to the backyard grass area to make easier access for Mrs. Larrson as well as enlarge <br /> the current float that is there. The design did have the benefit of some negotiations with the <br /> harbormaster and this is the one that he accepted. He noted unfortunately DEP has not issued a file <br /> number yet. He was hoping to go thru the questions the commissioners have and perhaps close the <br /> hearing and issue the order of conditions contingent upon receipt of that number. The Agent stated the <br /> commissioners cannot issue the order of conditions without the DEP number. <br /> The Agent stated we did have a discussion regarding the additional float. The 12 by 6 float did come <br /> into question. He read the harbormaster's comments which included mitigation and will hold off on the <br /> mitigation which will be reviewed by the Selectmen. He said based on the shellfish constable's <br /> assessment of the area, 150 square feet is assumed to be the average float size and the regulation <br /> describes it is the consensus among the conservation commission, the harbormaster and the shellfish <br /> constable as to what you see proposed before you. The secondary float asks the question what is the <br /> compelling need for an additional float in this area. He said the harbormaster has been consulted and <br /> is fine with the location and everything else conforms to regulation 27 Docks, Piers, and Floats. He <br /> said he talked to Mr. Pesce about the portion of the dock that expands over the salt marsh and we like <br /> to see Tru flow decking over areas of elevated walkways that traverse salt marsh that is also Marine <br /> Fisheries recommendation for a 6-foot height of mean high water in allowing more sunlight to penetrate. <br /> Mr. Pesce noted the Larrson family has had this for 24 years and they have two boats. They have <br /> discussed this with the harbormaster and described how these boats would be moored. He noted this is <br /> a tremendous improvement of the use of their property going forward. <br /> The Agent inquired about a compelling need for an additional float and is it practical to accommodate <br /> mooring a boat. He didn't consider it being a compelling need but based on the shellfish comments <br /> and since this is land containing shellfish, he thinks the 20 by 8 is sufficient and it does provide <br /> opportunity for two boats. <br /> Mr. Larrson said having a second larger boat parked parallel would have more impact on the shellfish <br /> than.one out at the 3-foot depth line. Mr. Pesce asked if the Commissioners would consider a <br /> compromise if they would remove the L shape and make the float a 10' X 20' which would be more <br /> accommodating to the boat. It makes it safer to get in and out of the boat and more parallel to the <br /> shore. Mr. Pesce said he will discuss it with Mr. Larrson and consider the possibility of a shellfish <br /> survey. <br /> No comment from the public <br /> Mr. Pesce requested a continuance on behalf of his applicant. <br /> Motion: Mr. Sweet moved to continue the hearing at the request of the applicant to April 11, <br /> 2019 at 6:00, seconded by Mr. Dalton.
