6:09 Akram E. & Marta O. Rafla, Trustees, 45 Little Neck Lane. Proposed <br /> expansion of existing float and relocation of a piling. RDA <br /> Resource Area: Land Under Ocean, LSCSF <br /> Mark Burtis represented the applicant. He stated they were proposing to construct a <br /> new 8 by 40 ft. float system to replace existing 8 by 24-foot system to prevent boat from <br /> resting on bottom at low tides. The existing pile will be reset to accommodate the new <br /> float. <br /> The Agent stated he met with the harbormaster and the shellfish agent and both have <br /> signed off on the project. He noted the area on the photos provided. He suggested <br /> contacting Chapter 91 to see what they have on record so they could update their <br /> records accordingly. <br /> Comment from the public <br /> Arlene Wilson noted a permit that was issued under the MA DPW under Chapter 91 is a <br /> Chapter 91 license and as long as it is properly recorded it doesn't need to get <br /> relicensed if the pier is in the right place. The Agent stated it will need to be reviewed <br /> and recorded with Chapter 91. A copy of an updated Chapter 91 license (approving new <br /> float configuration) will be required to be submitted to concom <br /> Motion: Mr. Sweet moved a Negative Determination with the condition they <br /> secure a Chapter 91 permit and file it with the Conservation Commission, <br /> seconded by Mr. Dalton. Vote unanimous 4-0 <br /> Discussion: Potential osprey installation on Conservation land at 77 Whippoorwill <br /> Circle <br /> The Agent stated there is a parcel of land at 77 Whippoorwill Circle which he noted on a <br /> photo. Cass Costa and Marlene Susienka who were present are interested in putting an <br /> osprey nest in the area. They noted some of the residents in the area would pay for the <br /> materials. The Agent stated the Commissioners could require a permit or approve the <br /> request with an administrative action. The Agent suggested the request should be in <br /> writing referencing the parcel. <br /> Motion: Mr. Sweet moved to approve the installation of a nesting platform as an <br /> administrative action. Vote 4-0 <br /> Administrative Approval: Mashpee Waterways - Popponesset Spit nourishment— State beacl <br /> portion (DEP file #43-2616). Request to use trucked in sand for maintenance nourishment— <br /> State MA FWS beach area of the spit <br />
