Tom <br /> Staruch from Quality Tree Service will be doing the work. The Agent stated he went to <br /> the site and showed photos of the trees which are to be removed. <br /> No comment from the public <br /> Motion: Mr. Dalton moved a Negative Determination, seconded by Mr. Sweet. <br /> Vote unanimous 4-0 <br /> 6:03 John J. & Catharine J. He <br /> explained the proposed project is to construct additions on an existing family home. He <br /> reviewed the plan that shows the wetland boundary and the 50 ft. setback and the 100 ft <br /> setback. He said he met with the Agent because they were concerned if there would be <br /> a need for mitigation plantings. He provided the Commissioners with a landscape plan <br /> and noted the plantings would be in the area that was either shrubbery or grass. He <br /> said on the seaward side they have a proposed addition but it is going over the existing <br /> deck. They are enclosing the area below which is presently being used for storage and <br /> a 4' deep frost foundation is required. The one concern he highlighted was an oak tree <br /> that may need to be pruned and a worst-case scenario is the tree would have to be <br /> removed. At this time, he said he cannot say the frost wall would be detrimental to the <br /> tree. He said they will not know until they construct the frost wall to see how much of <br /> the root system will be undermined. He suggested if we find the need to have the tree <br /> removed, we would work with staff to determine what mitigation would be necessary for <br /> replacement of the tree. The Agent said because it is a wait and see approach they <br /> could work with the staff at the appropriate time because there would be ample <br /> opportunity for additional plantings just inside the salt marsh line. Mr. Gray said the <br /> homeowners are amenable to do any mitigation if necessary if the tree comes out. <br /> No comment from the public <br /> Motion: Mr. Sweet moved to Close and Issue with the condition if there is <br /> damage to the oak tree that staff would figure out the best way to handle it. <br /> Seconded by Mr. Dalton.
