Resource Area: John's Pond, Bordering Land Subject to Flooding <br /> Michael and Christine Butera, homeowners, were present. Christine described they are <br /> proposing to replace old rotted wood, plastic patio with natural bluestone, set on stone <br /> dust and add blue stone to an existing level backyard predisturbed area set on stone <br /> dust which did not require any removal of vegetation, shrubs or trees and install 4-foot <br /> privacy fence between houses. She noted the area of where the fence is proposed to <br /> be installed. <br /> The Agent noted the patio areas on photos and noted these were after the fact and no <br /> vegetation was removed. He said there was nothing done to impact the resource areas. <br /> No comment from the public. <br /> Motion: Mr. Sweet moved a Negative Determination, seconded by Mr. Dalton. <br /> Vote unanimous 4-0 <br /> 6:09 Julieann E. Rainville, Trustee, 19 Keel Way. Proposed hardscape and <br /> landscape modifications and mitigation plantings. NOI <br /> Resource Area: LSCSF, buffer zone to BVW, salt marsh and Land Under Ocean <br /> Wayne Tavares, Wet Tech Design, represented the applicant. He explained the <br /> proposed project includes taking out a portion of the deck and moving it to the other <br /> side. They would also like to use the existing mitigation plantings, prune them, fertilize <br /> them once and add irrigation and supplement the planting. The Agent noted there is a <br /> black oak tree hanging.over the house and agreed it should be removed along with a <br /> branch that's hanging over the boardwalk. The existing blueberry-beach plum will be <br /> pruned heavily to stimulate growth. Mr. Tavares stated they are also looking for a <br /> waiver to work in the 50' buffer zone to construct a 10 x 12 utility shed on the property <br /> line as well as a maintenance plan for poison ivy. <br /> The Agent stated they looked at all of the mitigation areas. He noted the areas on <br /> photos and where the decking will be going. He requested a mitigation calculation be <br /> done and the setbacks added to the plan. <br /> No comment from the public <br /> Motion: Mr. Sweet moved to Close and Issue with the condition that a mitigation <br /> plan be done along with delineating setbacks on the plan to make up the location <br /> of the shed. Seconded by Mr. Dalton. Vote unanimous 4-0 <br /> 6:12 Thomas D. Woodson, 43 Birch Way. Proposed reconfiguration of lower and <br /> upper decks, addition of steps, expansion of kitchen and porch areas, and <br /> construction of a retaining wall. NOI <br />
