Resource Areas: Buffer zone to BVW, Land Under Waterbodies and Waterways,
Inland Bank, Mashpee Pond
Raul Lizardi-Rivera, Cape & Islands Engineering, represented the applicant. He
explained the project is to remodel the inside and the outside of the house and
reconstruct the rear deck and the expansion of the front porch. None of the proposed
modifications of the deck will be any closer to the resource area. There will be no
cutting of trees. In the front, the expansion on the house is a kitchen so the kitchen will
be expanded onto the area that is a porch so a new porch will be added. He noted on
the plan where the proposed retaining will be installed to allow for the lower deck to be
one level. He explained a portion of the work is after the fact work. The proposed work
within the 100' buffer to the inland bank, consists of the removal of the existing upper
and lower decks which had to be removed for safety, reconstruction of the upper and
lower decks with stairs, the construction of a retaining wall, construction and
maintenance of an addition to the front portion of the of the residential single family
dwelling, expand the covered porch and associated clearing, grading, utilities and
landscaping.
The Agent showed pictures of the property. He noted the limit of work goes along the
top of the inland bank so there is no disturbance to the inland bank. We received the
letter from Natural Heritage indicating a no take exemption status. The Chair suggested
specifying the walkway will be a pervious surface and to make sure the soil on the bank
is secure. The Agent stated this could be a condition placed on the project.
No comment from the public
Motion: Mr. Sweet moved to Close and Issue with the condtions as described,
seconded by Mr. Dalton. Vote unanimous 4-0
6:15 Karl & Jill Schneider, 14 Nick Trail. Proposed construction of additions to an
existing dwelling. RDA
Resource Area: LSCSF, Buffer Zone to Freshwater wetland
Kenneth Breivogel, J.E. Landers-Cauley, represented the applicants. He explained the
addition will not require a modification of the sewerage disposal system nor a change in
grading. The project is not going to increase the number of bedrooms and will utilize
the existing disposal system. He explained the proposed project is the addition of two
rooms on an existing dwelling which conforms to Title 5 and following the completion of
the construction of the additions, all disturbed areas from construction will be planted
with a combination of indigenous plants.
The Agent informed Mr. Breivogel that the Board of Health must be contacted regarding
the additions and the order of conditions will be contingent upon Board of Health
approval. He reviewed photos of the site noting the hardscaping and the lawn.
