Ms. <br /> Almquist agreed that peroxide is more environmentally friendly and safer for the dogs. <br /> There being no further comments or discussion, Laurel Almquist moved to continue discussion of the Title V <br /> Design Plan approval at 31 Evergreen Circle to the May 16, 2019 meeting. Motion seconded by Brian <br /> Baumgaertel, VOTE; Unanimous(2-0). <br /> OLD BUSINESS <br /> 1. Discussion of May Town Meeting Articles submitted by the Board of Health. Mr. Harrington stated <br /> that he had read through the warrant in its entirety. He offered the following comments; <br /> • Article 8 is proposing to impose a local excise tax for bed and breakfast establishment,hotel, <br /> lodging house, short-term rental or motel, equal to 6% of the total amount of rent paid for <br /> each occupancy. <br /> • Article 20 is proposing to create a new Assistant Health Agent position within the Health <br /> Department. The FINCOM voted 4-1 to support the Rental Property Bylaw, but voted <br /> unanimously not to support the new position. <br /> Chair Baumgaertel stated that it is difficult to defend the position when there isn't first the <br /> opportunity to explain the bylaw, but it would be worse if the Town were to vote in favor of <br /> the bylaw and then vote the new position down. Mr. Harrington stated that the Town is <br /> counting on residents to register and pay their fee and tax but, without knowing how much <br /> income that will generate, it is difficult to justify the expense of the position. He further <br /> stated that the board is not looking to spend money the Town doesn't yet have but, in order <br /> to protect the public, there may need to be some up-front investment. Furthermore, if the - <br /> Health Department can inspect these properties and fix any legitimate issues, it makes <br /> Mashpee more appealing in terms of better vacation rentals. Another benefit that Mr. <br /> Harrington noted with regard to inspectional services is that the laws in Massachusetts are <br /> set heavily toward the tenant and,if a third party inspects the property before a tenant takes <br /> occupancy, it offers some protection to the landlord. <br /> • Article 25 is proposing to continue participation in the Community Septic Management <br /> Program. Mr. Harrington indicated that this is a "housekeeping" article. Chair Baumgaertel <br /> noted that the program has now loaned out over$45M. <br /> • Article 28 is the proposed Rental Property Bylaw. Mr.Harrington advised the board that they <br /> can indefinitely postpone the bylaw if the new position isn't approved, because the Health <br /> Department won't have the staff to enforce it. Chair Baumgaertel asked who would be the <br /> spokesperson should that be the case at Town Meeting,and Mr. Harrington indicated that it <br /> would need to be a board member. <br /> 2. Review and discussion of draft Innovative/Alternative Septic Regulation. Mr. Harrington <br /> commented that, at the last meeting, Matt Costa, of Cape and Islands Engineering, made public <br /> comments relative to the draft regulation. He recommended service contracts for all maintenance, <br /> approvals by a health agent, requirement/enforcement of pressure distribution, and minimum <br /> training requirements for those performing I/A inspections. Some of those comments were <br /> incorporated into the draft regulation for consideration by the board. <br /> 2 <br />
