Request Certificate of <br /> Compliance 43-2951 COC <br /> This was for a retaining wall project which was finished but there were some violations on that <br /> project of clearing some vegetation. There is a condition that on the property to conduct a <br /> biannual maintenance. He wanted to let them know it doesn't dismiss the monitoring of the <br /> mitigation plan. <br /> Minutes: May 9, 2019 Minutes <br /> Motion: Mr. Sweet moved to approve the May 9, 2019 minutes, seconded by Chad Smith. <br /> Vote 4-0-1 with Mr. Dalton abstaining. <br /> Evergreen Circle: Presentation of restoration plan of the Conservation Restriction — LEC <br /> Environmental <br /> The Agent stated this Conservation Restriction area was disturbed with about 5 acres of land <br /> being cleared and LEC was brought on board to come up with a restoration mitigation plan which <br /> they will present tonight. <br /> Mike Ford, legal counsel to Evergreen LEC was present. He stated this is a subdivision that <br /> was originally approved by the Cape Cod Commission and under the open space requirements <br /> of the Commission a large section of the property had to be set aside to open space. In the <br /> course of the operations of an abutter to the rear there was an encroachment into the area that <br /> had been set aside for open space. The Commission is happy to take whatever remediation <br /> plan is approved by the local Conservation Commission. There were two options, one was <br /> almost 26 acres could be subject to a conservation restriction in perpetuity. The preference was <br /> they preferred we turn the title of the property over to the town and it would be under the <br /> Conservation Commission control. This area which needs to be remediated needs to be <br /> addressed first and we are here to ask you to take a look at the remediation plan. This plan has <br /> been reviewed by the Agent and he suggested changes and the changes were made. He noted <br /> the Board of Selectmen would also need to approve the plan. <br /> Jim, LEC, reviewed the restoration area. The area has been cleared and stripped of top soil and <br /> stumps. The plan is to restore the land as native meadow and nonnative soils will be removed <br />
