MASHPEE ZONING BOARD OF APPEALS <br /> Petitioner: Habitat for Humanity of Cape Cod,Inc. <br /> Owner of record: Estate of Leonard Mendes <br /> 341 Great Neck Road North(Map 60 Parcel 13) <br /> Mashpee,MA 02649 <br /> CP-2019-29 <br /> 6. The Petitioner is a non-profit corporation duly organized and existing under the <br /> laws of the Commonwealth of Massachusetts. Accordingly, the jurisdictional <br /> requirements under 760 CMR 56.00 have been satisfied. <br /> 7. The subsidizing agency is the Department of Housing&Community Development <br /> (DHCD).Per a Determination of Project Eligibility Letter(PEL)dated January 15, <br /> 2019,project eligibility under the Local Initiative Program(LIP)was granted. <br /> 8. The property is currently owned by Lois R.Mendes,as Personal Representative of <br /> the Estate of Leonard Mendes.The Petitioner has entered into a purchase and sale <br /> agreement on July 10,2017. <br /> 9. A Special Town Meeting was held on May 7,2018,under Article 6, a majority of <br /> eligible voters, authorized that..."Since the Great Neck Road North site does not <br /> conform to current zoning requirements,an M.G.L. c.40B Comprehensive Permit <br /> will be required by the Zoning Board of Appeals." <br /> 10. On November 19, 2018, the Board of Selectmen voted to support the Habitat for <br /> Humanity of Cape Cod Local Initiative Program (LIP) application for two (2) <br /> affordable homes. <br /> 11. On January 15, 2019, Habitat for Humanity of Cape Cod, Inc., submitted a <br /> proposal to the Board of Selectmen for the development of two(2)homeownership <br /> units. <br /> 12. On April 3, 2019, the ZBA received an electronic draft copy of the Petition, and <br /> was distributed electronically to the appropriate Town Departments. <br /> 13. On April 24, 2019,the Habitat for Humanity of Cape Cod, Inc., (Petitioner) filed. <br /> for a Comprehensive Permit with the Mashpee Town Clerk. The Town Clerk <br /> retained the Petition with original signatures. The Petitioner delivered the <br /> remainder of the date-stamped copies to the office of the Zoning Board of Appeals. <br /> 14. On April 4, 2019, Catherine Laurent, DPW Director submitted an electronic <br /> comment to the ZBA office. "DPW has no concerns with the proposed driveway <br /> but a Curb Cut Permit from the DPW will be required. When applying for this <br /> permit, the applicant will need to provide more detailed plans for the driveway <br /> entrance, specifically,how the apron will integrate with the existing sidewalk and <br /> granite curbing.In addition,as shown on the plan,there is an existing storm water <br /> facility for Great Neck Road North located within the road layout along the <br /> frontage for the property. The applicant will be required to provide erosion <br /> protection along the property line to prevent disruption and sedimentation of this <br /> facility during construction.Finally,during construction,all access should be from <br /> the proposed driveway location. There should be no parking or other activity <br /> allowed within the road layout that blocks or restricts use of the sidewalk." <br /> 2 <br />
