Board of Selectmen <br /> Minutes <br /> June 17, 2019 <br /> APPOINTMENTS & HEARINGS <br /> Public Hearing continued from June 3, 2019 - Request for Modification of Entertainment License: <br /> Naukabout Beer Company, LLC: Peter Murner: <br /> The Hearing continued from June 3, 2019 was re-opened. Acting as the Licensing Authority for the Town of <br /> Mashpee, the Board of Selectmen considered the possible modification to the Entertainment License of <br /> Naukabout Beer Company LLC d/b/a Naukabout Beer Company, LLC, 13 Lake Avenue, Mashpee. <br /> At the last meeting, the Board motioned to allow the applicant Peter Murner to work with the Town Manager's <br /> Office to develop a specific proposal regarding the proposed outdoor entertainment and the terms and conditions <br /> to be considered. <br /> Peter Murner co-owner and general manager of Naukabout Beer Company indicated after productive meetings <br /> with the Town Manager, a straight forward proposal was brought to the Selectmen for consideration. From May <br /> through September,the hours of outdoor entertainment would be 12:00 p.m. noon until 8:00 p.m. From <br /> September to May, the hours of outdoor entertainment would be held from 12:00 p.m. noon until 6:00 p.m. <br /> After one month, the outdoor entertainment to be restricted to acoustic music with no live amplified music and <br /> no disc jockeys would be reviewed. <br /> The outdoor entertainment would be offered on Friday and Saturdays with possible Sunday entertainment to <br /> include a possible mid-week day to accommodate a special event. During the summer outdoor entertainment <br /> would consist of 2-3 days per week and off season one day per week. With the sun setting at approximately 8:30 <br /> pm. all outdoor entertainment and service would cease and move indoors. The establishment currently closes at <br /> 9:00 P.M. <br /> After a period of one month, there would be an open opportunity for discussion to review and identify any <br /> problems or complaints. The applicant would have a 30 day window to address any complaints. It was agreed <br /> the applicant would be neighborly, and not upset the abutters. The speakers would be no louder than the outside <br /> piped music currently permitted for. Placement and direction of speakers would be tweaked by the applicant to <br /> minimize sound. Mr. Murner was agreeable to the directive of the Board of Selectmen. <br /> The Board opened the hearing to solicit comment. Barbara Nichols of 23 Melissa Avenue related concern <br /> regarding noise emanating from the beach. This includes the radio, loud music, and the ice cream truck without <br /> any amplification. In concern Mrs. Nichols indicated the prevailing south winds will cause noise. In closing <br /> Mrs. Nichols stated that it is the mission of the Board of Selectmen to live in harmony with nature. She is <br /> greatly opposed to the outdoor entertainment proposal as it does not harmonize with nature. <br /> Jen McDonald gave support to the vision of the Naukabout Beer Company. She has visited the site on many <br /> occasions, and the proposal to provide outdoor entertainment is not offensive, but very natural and fitting with <br /> the clientele. Ms. McDonald recommended the Board of Selectmen give Mr. Murner the opportunity to try the <br /> outdoor entertainment and added that it is great to hear music outdoors and to not be inside. <br /> As discussion continued amongst the Board members it was noted there is no method to predict the outcome of <br /> the sound unless it is tried. Mr. Murner was advised to amplify the voice only and not the instruments. <br /> 5 <br />
