Board of Selectmen Minutes July 8, 2019 NEW BUSINESS Discussion and Approval to Execute an Amendment to the Conservation Restriction on Land in the Towns of Barnstable and Mashpee dated June 12 2002 Barnstable County Registry of Deeds in Book 15305 at Page 123): The Board of Selectmen was in receipt of a memorandum from Assistant Town Manager Wayne E. Taylor dated July 3, 2019 relative to the Mills Properties. The Board of Selectmen was requested to execute an amendment to the Conservation Restriction to incorporate additional properties to the Santuit Pond conservation area in the Towns of Mashpee and Barnstable. The amendment to the Conservation Restriction will enable the Town of Mashpee Community Preservation Committee to accept funding from the Town of Barnstable in the amount of$150,000 to reimburse the CPC for the Mills Land purchase. This project has been ongoing for a number of years. Motion made by Selectman O'Hara that the Board of Selectmen, acting on behalf of the Town of Mashpee as a co-owner of the premises subject to a Massachusetts Department of Fish and Game Consensual Order of Taking of Conservation Restriction (the "Conservation Restriction") on land in the Towns of Barnstable and Mashpee, Barnstable County, Massachusetts, dated June 12, 2002 and recorded in the Barnstable County Registry of Deeds in Book 15305 at Page 123, and pursuant to Section 3 of Chapter 149 of the Acts of 2013,vote to agree to amend said Conservation Restriction to include the additional lands known as the "Mills Family Parcels" as described in Exhibit A of the Agreement to Amend Conservation Restriction such that the terms and provisions of said Conservation Restriction will apply to said additional lands and that the Board vote to execute said Agreement to Amend Conservation Restriction. And further, to hold signing the Agreement until the Town of Barnstable takes their vote to authorize $150,000 to the Town of Mashpee. Motion seconded by Selectman Sherman. VOTE: Unanimous. 4-0. Roll Call Vote: Selectman Gottlieb,yes Selectman Cotton,yes Selectman O'Hara,yes Selectman Sherman,yes Opposed, none Discussion of the Town Pickleball Courts: The Board of Selectmen met with Ernest Barrows to discuss the noise emanating from the Pickleball Courts located at 156 Ashumet Road, Mashpee. The Board of Selectmen was in receipt of a petition signed by 16 residents in concern to the noise level. Mr. Barrows indicated this problem has been ongoing since the construction of the Pickleball Courts. With the clearing of the trees and loss of vegetation the sound of the Pickleball and noise of the players is repetitively disturbing. Additional noise is also created by the Dog Park. Mary Waygan a resident of 35 Ashumet Road indicated she resides a distance from the courts and is not disturbed by the volume of noise. Ms. Waygan indicated she walks in the area and the repetitiveness of the game appears to be the problem. It is the recommendation of Ms. Waygan to grant the residents some relief. 10
