Town of Mashpee
16 Great Neck Road North
AOLG Gam" Mashpee, Massachusetts 02649
BOARD OF HEALTH - PUBLIC SESSION
Mashpee Town Hall — South Cape Meeting Room
Minutes of the Meeting of August 22, 2019
Board Members Present: Member Absent: Also Present:
Brian Baumgaertel, Chair Glen Harrington, Health Agent
Laurel Almquist,Co-Chair
Mallory Langler,Clerk
Chair Brian Baumgaertel called the meeting to order at 7:04 p.m.
APPOINTMENTS
7:15—502 Main Street
Glen Harrington commented that the owner who was operating the establishment in January 2019 had
failed to submit the online renewal applications, despite several notifications from our office that food
and tanning permits had expired. The previous owner has since re-acquired the establishment and
submitted the appropriate permit applications, but has not yet paid the related fees. Mr. Harrington
recommended that the current owner be required to pay double permit fees for failing to renew the
permits in a timely manner. ServSafe and Allergen Awareness Certificates are current.
Mallory Langler asked how long the establishment had officially been operating without a permit, and Mr.
Harrington answered that it had been seven months. During that time, numerous offers had been made
to train/assist the previous owner in completing her online renewal. The current owner had operated the
establishment for 10-12 years, and is very familiar with the permitting requirements. Ms. Langler was of
the opinion that it would be unfair to impose fines on the current owner, based on the failure of the
previous owner to meet the permitting requirements.
Mallory Langler moved to waive the$200/day fines for The Fit Company for Women, and instead impose
double permit fees for both the Tanning Permit and Food Establishment Permit, with the total Tanning
Permit fee being $200 and the total Food Permit fee being $400. Motion seconded by Laurel Almquist.
VOTE: Unanimous(3-0).
7:20—256 Monomoscoy Road
Mr. Harrington commented that the existing septic system at this address failed by regulation, as it did
not have the required four feet to groundwater. The proposed system is for four bedrooms, consisting of
the existing 1500 gallon septic tank, and a proposed pump chamber to an L-shaped Soil Absorption System
(SAS) utilizing pressure distribution. The plan is before the board due to a request to drop the proposed
SAS one foot closer to groundwater than required.
1
