No public comment
Motion: Brad Sweet moved a Negative Determination, seconded by Charles Dalton.
Vote 4-0
6:06 Sharad & Donna Joshi, 35 Timberlane Dr. Proposed removal & reconstruction
of existing access steps within the same footprint. Proposed removal of existing
float and replacement with fixed pier and float configuration with public access
steps.
Resource Areas: Inland Bank, BVW, Land Under Waterbodies and Waterways
(Santuit Pond)
Mark Burgess of Shorefront Consulting represented the applicant. Mr. Burgess described
the project to the commissioners. The project involves repair of the existing access
stairway down the inland bank (not complete removal and replacement) and construction
of a fixed pier and float into Santuit Pond. The fixed pier will also have access steps on
either side just above the high water mark for public access over the dock as per Chapter
91 requirements. The Agent commented on the long term endurance of a fixed pier in
freshwater given the likelihood of ice damage each year. Mr. Burgess said that he
recommends that the homeowner install a bubbler to address this issue. Dale McKay
commented on the same concern and asked about the piles and endurance thereof. Mr.
Burgess recommended that the homeowner go with fiberglass coated piles instead of
wood, thus reducing possible ice damage and uplifting from ice rafting in the winter. Mr.
McKay also commented on the requirement of the home address and DEP permit number
display on the dock and the Agent confirmed this requirement on all separable portions of
the dock. The Agent recommended a Close and Issue.
No comment from the public
Motion: Mr. Sweet moved to Close and Issue seconded by Mr. Dalton. Vote 4-0
unanimous
6:09 James P. DeVincent, 122 Old Brickyard Rd. Seeking authorization for an
existing shed on the shoreline of Johns Pond. RDA
Resource Areas: Bordering Land Subject to Flooding, Buffer Zone to Land Under
Waterbodies and Waterways (Johns Pond)
James DeVincent (homeowner), described the request to permit an existing shed over
sandy beach bordering Johns Pond on his property at 122 Old Brickyard Rd. Mr.
DeVincent described the background of the situation. The area of the existing shed was
previously occupied by a playground structure roughly the same size as the existing shed.
In the process of closing out some certificates of compliance, Mr. DeVincent realized that
the swapping of the shed for the playground was not reviewed/authorized by the
commission. Dale McKay inquired about the shoreline area of the property being on an
old road layout called Sakonnett Drive. The Agent clarified that the road layout was likely
underwater in this particular location and the homeowner's property runs to the shoreline
of Johns Pond.
No comment from the public
