MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> DECEMBER 11,2019 <br /> Mr.Tom Smith,represented the petition for a Variance for an existing deck on the property. <br /> Tom said that he was given a building permit back in 2018 for the existing layout. <br /> Ron asked Tom if he had Conservation approval. He said he was issued an Order of <br /> Conditions that was filed two years ago. He said he is amending the permit because he has <br /> to have vista pruning. Tom said that the deck is 10 ft. above the ground, and the supports <br /> are 7 ft. from the house. The setback of the house is 50 ft. from the wetlands. He said that <br /> he spoke to Mike and that he didn't have to go to the Zoning Board of Appeals. <br /> Ron wanted to know what the actual'amount of the setback. Tom asked Charlie if he could <br /> help him determine the distance. Tom said that the deck is cantilevered 3 ft., and it's 7 ft. <br /> from the edge of the foundation to the posts which support the 10 ft. deck. Charlie said that <br /> a 3 ft. cantilever is not allowed on a 7 ft. deck. <br /> Jonathan wanted to know if there was a revised site plan. The Board noticed that the deck <br /> was already built prior to the application for the variance relief. Charlie commented that <br /> the house does not match the permit that was applied for. Charlie asked if the site plan <br /> shows an existing house or is it proposed. Jonathan wanted to know if there was an <br /> approved plan with signature from Board of Health and Conservation. Charlie said that this <br /> plan does not match the original house. Charlie said that the deck was built without <br /> inspections. Charlie failed the foundation as-built because it didn't match the original <br /> plans. <br /> The Board wants a revised plan that was approved, and a new plan of what is proposed. <br /> The approved plan should be signed off by the departments involved. <br /> Ron made a motion to accept the applicant's request for a continuance until January 22, <br /> 2020. Mr. Blaisdell seconded. All were in favor. <br /> 11 Hamblin Road: Owners, Jacques and Martha Morin request a Modification of an <br /> approved Variance (V-2018-16), reducing lot coverage by relocating hot tub under deck, <br /> and expanding the deck on the dwelling located in an R-3 Zoning District,Map 120 Parcel <br /> 34, Mashpee, MA. <br /> Jacques represented himself for the modification request of a variance that was granted <br /> back in 2018. He is specifically looking to relocate the hot tub which is in the patio 6 ft. <br /> from the wall at the water's edge, and move it underneath the deck and at the same time <br /> move the deck 1 ft. 9". <br /> Jonathan asked Charlie if the hot tub is included in lot coverage. Charlie said; yes, it's <br /> similar to a pool. Jonathan asked how much lot coverage is being removed. <br /> 4 <br />
