There being no further comments or discussion,Veronica Warden moved to approve the Commercial Site <br /> &Septic Plan for 89 Industrial Drive with the following conditions: 1)the engineer change the perc rate <br /> on the plan to two(2)minutes per inch,and 2)all standard commercial property conditions apply. Motion <br /> seconded by Mallory Langler. VOTE: Unanimous(3-0). <br /> 7:25—Title'V Violation,Louis Gallo <br /> Mr. Harrington commented that, on June 14, 2018, a Disposal Works Construction Permit was issued to <br /> relocate a septic tank at 28 Sampsons Mill Road. The approved design plan was prepared by Falmouth <br /> Engineering,and the final inspection of the septic tank was performed by the Board of Health on June 22, <br /> 2018. An order letter dated January 3, 2019 was sent to Mr. Gallo stating that the designer and installer <br /> shall certify the installation within 30 days of final inspection. Duplicate as-built cards were provided to <br /> Mr. Gallo for his signature and the designer's signature; however, both as-built cards were returned to <br /> the Board of Health on January 14, 2019 signed by Mr. Gallo. Mr. Harrington stated that, when he <br /> contacted the engineer, Mike Borselli, he was informed that Mr. Borselli was never contacted to inspect <br /> the finished work. The owners have since completed the addition that caused the relocation of the septic <br /> tank and are now requesting occupancy of the addition. Mr. Harrington confirmed that Mr. Gallo's as- <br /> built does match the septic design plan, but the engineer has refused to sign off on the work. <br /> Louis Gallo introduced himself for the record, and gave a brief history on Gallo Construction Company. <br /> He also gave his best recollection of the circumstances surrounding this lapse in.protocol. Ms. Langler <br /> asked if Mr. Harrington,thought Mr. Borselli would be willing to inspect the tank if it was uncovered, and <br /> Mr. Harrington answered that he would inquire with Mr. Borselli. Ms. Langler suggested that Mr. Gallo <br /> contact the property owner to make arrangements for an inspection,as it is the only way to close out this <br /> project. <br /> There being no further comments or discussion, Mallory Langler moved to continue show cause hearing <br /> pending coordination between the installer and the engineerto schedule an inspection. Motion seconded <br /> by Veronica Warden. VOTE: Unanimous(3-0). <br /> OLD BUSINESS <br /> 1. Review of Compliance — Refuse Violation, Cabral Container, 81 Echo'Road. Mr. Harrington <br /> reminded Board members that Mr. Cabral had appeared at the meeting on January 9, 2020 and <br /> stated that the pile would start to be removed the following Monday. Mr. Harrington reported <br /> that he and the Assistant Health Agent have been checking regularly, but there has been no <br /> activity at the site since the last meeting. Mr. Harrington also attempted to contact Carl Cavossa, <br /> but had not heard back. <br /> Ms. Warden recommended that Mr. Cabral's trash hauler's license be revoked, and Mr. <br /> Harrington advised the Board that a show-cause hearing would have to be held and Mr. Cabral <br /> would have to be given written notice. Mr. Harrington will ensure Mr. Cabral is given proper <br /> notice of the hearing,which will be held at the next meeting. The purpose of the hearing would <br /> be to discuss compliance of the property,with the potential for revocation of Mr.Cabral's trash a <br /> hauler's license. The Board agreed that, even though fines would unlikely be recovered, in the <br /> Interest of following the regulation,it also might be necessary to impose fines at the hearing,with <br /> the understanding that they can be withdrawn at a later date. Mr.Harrington informed the Board <br /> that a request for funds would have to be made to the Finance Committee to cover the cost of <br /> removing the trash pile,which would result In lien on the property. . <br /> 2 <br />
