2. Review of Short-Term Rental Property Regulation, Mr.Harrington commented that,the recently <br /> approved Rental Property By-Law has two references in It to a Board of Health Regulation which <br /> does not exist. At the meeting held on December 19,2019,the Board requested that the Health <br /> Agent create a draft regulation. A draft regulation was subsequently created, which addressed <br /> the two matters of concern brought up by the Cape Cod Realtors Association. Mr. Harrington <br /> stated that he.had spoken with Ryan Castle of the Realtors Association,who agreed to meet for <br /> the purpose of discussing the regulation once it has been prepared. Mr, Harrington advised the <br /> Board that approximately 350 short-term rentals had registered with'the state. There was <br /> discussion as to whether there was a need to add language relative to "reasonable notice" for <br /> Inspections. <br /> 3. Update on,amendment to Mashpee Regulation Restricting the Sale of Tobacco. Mr, Harrington <br /> commented that we received an opinion from Town,Counsel that we could_not use the word <br /> "Fronto" in the definition of blunt wraps, because we have to avoid showing favoritism or <br /> opposition to any one particular brand, The Board does not need to take any action, because the <br /> amendments would have to'have been advertised in order to be in effect, and they were never <br /> advertised. <br /> 4. Update on Santuit Pond —Algae Remediation Proposals. Mr. Harrington commented that, to <br /> address the algae issue plaguing Santuit Pond for the last three years, the Selectmen asked <br /> Conservation, Natural Resources and the Board of Health to come up with some short and long- <br /> term solutions. At a subsequent appearance before the Selectmen, Natural Resources and <br /> Conservation Agents proposed to drain a portion of the pond into adjacent cranberry bogs to <br /> allow the algae to be caught and filtered out into the bogs,with the goal of.displacing 78%of the <br /> phosphorus that's within the algae in the pond. This can be done several times throughout the <br /> winter to reduce the amount of algae in the pond. Board,members inquired if this has ever been <br /> done before, and Mr. Harrington answered that theoretically this works, but it has never been <br /> done before, <br /> Mr. Harrington stated that, to address the Board of Health's part in helping reduce phosphorus <br /> and other nutrients into the pond, he suggested to the Selectmen that septic inspections be <br /> required of every abutter within 300 feet of the pond. GIS provided a list of approximately 120 <br /> properties with 174 owners. If the Board agrees to require the*Inspections,.that leaves the <br /> question of cost for both the inspection itself and repairs to any system that fails. Board members <br /> discussed possible funding options, including the Town's own septic loan program as well as the <br /> County program, and Mr, Harrington reminded them that there is funding available if <br /> denitrification is used, and also for educational purposes and/or public outreach. Chair <br /> Baumgaertel suggested that re-siting the leach fields on some of the older properties abutting the - <br /> pond might provide some mitigation. Mr. Harrington suggested that the Town may even want to <br /> pay to pump some of the systems that hadn't been pumped in recent years. He advised the Board <br /> that phosphorus is only a concern within 300'of the pond,and shared date provided in the 2010 <br /> AECOM Report on Santuit Pond Various phosphorus'reducing technologies were discussed. Mr. <br /> Harrington informed the Board that a member of the Sewer Commission had proposed adding <br /> the Santuit Pond area to Phase I of the Comprehensive Watershed Nitrogen Management Plan. <br /> NEW BUSINESS <br /> 1.
