MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> APRIL 22,2020 <br /> Attorney, Andrew Singer and Sean Riley with Coastal Engineering were present. At the <br /> last hearing,the Board requested a revised site plan depict that there was no increase in lot <br /> coverage. Mr. Singer said he provided a revised site plan dated April 7`"with the requested <br /> revisions. He said that the Conservation Commission approved the project, and Mr. Riley <br /> spoke to the Health Agent and discussed some concerns. Mr. Singer requested that the <br /> Board would impose a condition that prior to construction that the Health Agent has signed <br /> off on the upgrades to the septic system. <br /> The site plan depicted the decrease in lot coverage from 37.5% reduced to 33.5% lot <br /> coverage. <br /> Sharon read the Board of Health comments into the record dated April 10, 2020. Mr. <br /> Furbush asked the applicant if he had a discussion with the Health Agent. Mr. Singer said <br /> he has not been able to connect, but asked if the Board could impose a condition as he <br /> mentioned earlier. <br /> Mr. Bonvie asked if the applicant needed to seek relief from the Board of the 50 ft. setback <br /> from the wetlands. Mr. Blaisdell read the Conservation comments dated April 10, 2020 <br /> stating that the Commission approved the project. Mr. Riley with Coastal Engineering <br /> mentioned that the septic tank is further away from the 50 ft. buffer. He said that when he <br /> spoke to the Health Agent there was no variance required. His concerns were the retaining <br /> wall and the depth of the retaining wall that would impact the stone around the soil <br /> absorption system.He said he provided a plan that depicts a footing that keeps the retaining <br /> wall above the soil absorption system,and addressed the issue of the septic and trench box. <br /> He has tried to connect with the Health Agent to discuss further concerns but requested <br /> that the Board condition upon his approval. <br /> Mr. Bonvie asked if any of the site work within 50 ft. of the resource area. Mr. Singer said <br /> that he believes the pavilion is approximately 100 ft. away. The work that is being <br /> performed within the 50 ft. is the removal of the existing deck and replacement of the patio. <br /> Charlie commented that he doesn't see an issue. <br /> There were no more comments from the Board or audience. <br /> Mr.Bonvie made a motion to approve the application for 78 Popponesset Island Road with <br /> the following conditions; <br /> 1. The Board has determined that the applicant meets all the conditions of a Written <br /> Finding under Mass General Law 40A Section 6. <br /> 2.
