Glen said that the space meets the requirement for a bedroom. <br /> • What is the total square footage of the garage? The Attorney said; it's 24' x 24' <br /> and is under 1,000 sq. ft. <br /> • Will there be an alarm system.The Attorney said; not sure yet. The Chief said this <br /> should meet the residential requirement and if it's a two-bay garage, it should have <br /> two heat detectors, and the space above will require minimally of one smoke <br /> detector and one CO detector.That will satisfy if turned into a bedroom,and should <br /> be tied into the main house. The Chief also mentioned he does not want anything <br /> in the garage when it's time for inspections. <br /> Evan Lehrer: <br /> • What the square footage was for the proposed principal structure? The Attorney <br /> said; 1,803 sq. ft., and the proposed is 3,073 sq. ft. <br /> • What is the finished space in the accessory structure?The Attorney said; 256 sq. <br /> Evan me;itioned that the accessory apartment bylaw stipulates that the accessory cannot <br /> exceed 4:0% of the gross floor area of the principal structure. If in the future this would <br /> become an accessory apartment, there is a minimum square footage requirement of 300 <br /> sq. ft. Future expansion could be an addition to the building, and would require a building <br /> permit. <br /> The Attorney said that there is a structure across the street on its own lot that will be <br /> demolished. Chief Rullo said that would require a permit. <br /> Evan said that the question for Town Counsel would be for Section 174-25 (1) (5). Does <br /> this need"to be passed along to the Zoning Board of Appeals because there's no use in <br /> the use 'table that deals with this? The ZBA would need to make a finding that is <br /> substantially similar to other uses in the Zoning District and issue finding a fact. <br /> Evan said in his opinion that the use table is very clear, and that the proposed use is within <br /> the use table and can be granted approval by the Plan Review Committee,-and there is no <br /> need for Town Counsel's opinion. <br /> Chief Rufllo stated that there can be a stipulation that the use is an office for a home <br /> occupation for the owner. <br /> Glen said that the Building Inspector's concern is that the use table didn't mention whether <br /> it was within the dwelling or in a detached structure. His opinion as mentioned by the Town <br /> Planner is that the use (occupation) goes with the property, and not the structure. <br /> Glen made a motion that the committee approve the proposal for the raze and replace of <br /> 29 Seconsett Point Road, with a detached two (2) car garage use on the first floor, and <br /> office with a bathroom use above with the following conditions; <br /> • Conservation Commission to address their concerns at their next meeting. <br /> • Board of Health—the septic system is shown on the revised site plan to determine <br /> the setbacks to the septic tank and soil absorption system. That a Variance be <br /> requested as required,and a septic permit is required to tie in the garage bathroom <br /> With existing septic system. <br /> 3 <br />
