MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> JUNE 24,2020 <br /> This lot is non-conforming because it does not meet those two criteria's, and in addition it <br /> allows for maximum lot coverage of 20% and a building height of 35 ft. Section 174-17.1 <br /> allows for a raze and replace project upon the grant of Special Permit relief by the Zoning <br /> Board of Appeals.The Board must find that there is no new non-conformities in connection <br /> with this project; that the proposed project is not substantially more detrimental to the <br /> neighborhood than the existing conditions,and there is sufficient land area for parking.The <br /> proposal also includes a garage, and currently there is no garage on site. The two non- <br /> conformities were eliminated. The dwelling will be setback the proper distance from the <br /> sidelines as well as the wetlands. The proposed lot coverage is 19.54%which is below the <br /> allowed 20%. The new construction will meet current day codes, and there is a new septic <br /> system that is part of this complete raze and replace project.The project has been approved <br /> by the Conservation Commission, and the Board of Health comments said that it requires <br /> approval by their department prior to issuance of a building permit. <br /> Chairman Furbush announced that Board Member, Jim Gould joined the meeting. Mr. <br /> Furbush asked Tom Bunker if he wanted to add any comments. Tom said that the non- <br /> conforming side setback has been eliminated, as well as the rear setback to the wetlands. <br /> There will be a new septic system installed. The existing house did not conform to the <br /> FEMA regulations as far as building in a flood zone, and the new house will comply with <br /> FEMA regulations. He had no further comments. <br /> Jonathan asked if there will be any dry wells installed, and Scott asked if there will be <br /> infiltration chambers. Tom pointed out that on both sidelines there are two high capacity <br /> infiltration chambers in the front and rear on the south side, and on the north side of the <br /> property line, there are a set of four infiltration chambers for the roof runoff. There is a <br /> catch basin in the driveway which will direct to the infiltration chambers; one on the north <br /> side and one just outside the garage door. Jonathan did not have any more questions. <br /> Ron wanted to know the dimensions of the existing setbacks from the wetlands. Tom said <br /> that it is 46 ft. from the patio to the wetlands, and 46 ft. from the structure to the top of the <br /> coastal bank, and 52 ft. from the structure. <br /> Bill Blaisdell said he does not have any issues. He said the project will be non-conforming <br /> than before. Scott agreed. <br /> Jonathan polled the members for any further comments. Jim Gould had no comments. Jim <br /> Reiffarth no comments. George was fine with the project. Jonathan said that he has no <br /> issues. <br /> There were no phone calls from abutters. <br /> Sharon read the Conservation Comments dated June 18, 2020 stating a permit was issued. <br /> She also read the Board of Health comments dated June 24, 2020. The Health Agent <br /> mentioned "that a septic plan must be approved by the BOH". Scott confirmed that a <br /> licensed septic installer has to file an application, and Board of Health will not sign off on <br /> the building permit. It's standard practice. <br /> 2 <br />
