Mr. Harrington <br /> commented that the owners are proposing a tear down/rebuild of their dwelling at 3 Pondview <br /> Road in Popponesset. The second floor plan depicts a standard door opening to a large room over <br /> the three-car garage. The dwelling is limited to three bedrooms as it is in a Zone ll. There is a <br /> master bedroom on the first floor and two primary bedrooms on the second floor. The room over <br /> the garage is labeled as a family room. Due to the standard door on the family room,the room <br /> meets the bedroom definition per the BOH regulation. The owners have applied for a variance to <br /> obtain options for the use of the room. <br /> Christy and Nancy Mihos introduced themselves for the record,stating that they have owned the <br /> house for 20 years with intention of moving here full time at some point. The new space over the <br /> garage would be used as a family room,and they want to have a door on it so they can close it off <br /> to keep energy costs down when the room is not in use. Chair Baumgaertel advised the Mihos' <br /> that the Board has never approved this type of variance before, and further stated that, in his <br /> opinion,there is no reason not to put in the 6' cased opening that would eliminate the privacy, <br /> especially with it being new construction. Mr. Harrington stated that the Board has to look at use <br /> beyond the current ownership. Where the room has privacy, is heated and finished, and has <br /> proper windows and ceiling height,it has to be treated as a big fourth bedroom. <br /> There being no further comments or discussion,Veronica Warden moved to deny the request for <br /> variance from the bedroom definition at 3 Pondview Road. The fine of$500 was paid and the permit fee of$500 was <br /> paid. The application for a 2020 Trash Hauler Permit was submitted and is being brought to the <br /> Board for approval. <br /> Ms.Warden noted that the applicant listed Cavossa Waste Facilities as one of their disposal sites. <br /> Mr. Harrington stated that the Upper Cape Regional Transfer Station (UCRTS) is still a permitted <br /> facility and Cavossa has an active lease and state permit to operate as the UCRTS. <br /> 5 <br />
