MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> JANUARY 13,2021 <br /> Jonathan has no issues.Ron wanted to know the setbacks when the lot was created in 1963. <br /> He recommended for future reference that the applicant research the setbacks because they <br /> may not have required a variance. <br /> Jonathan polled the Board for other comments. Sharon read the Board of Health, <br /> Conservation,and Town Planner comments into the record.Marshall said that Tom Bunker <br /> filed with Conservation and Board of Health. <br /> Dave Morris, Building Commissioner said that if the lot is a legally non-conforming lot, <br /> the applicant would just apply for a building permit, and if variances were required they <br /> would be reviewed by the Building Department. <br /> Ron made a motion to issue that the Board issue a Variance under §174-31 to vary the front <br /> setback and lot size requirements to allow for construction of a new single-family dwelling <br /> on property located in an R-3 Zoning District,Map 105 Parcel 184,Mashpee MA. (Owners <br /> of record: Lawrence A. Palmer and Karen R. Palmer) with the following conditions; <br /> 1. The Board has determined that the applicant meets all the conditions of a Variance <br /> under Mass General Law 40A Section 10. <br /> 2. Plot Plan — Proposed House and Subsurface Sewage Disposal System at 63 <br /> Waterway, Mashpee, MA. Prepared for Karen Palmer, Scale: 1"=20', Date: Nov. <br /> 3, 2020, Drawn by: EJP, RAR, Checked by: JER, Job Number: 17103, Title: Site <br /> Plan 1 of 2, Drawing Number: B25-55, Prepared by BSS Design Engineering & <br /> Surveying. <br /> 3. The site plan <br /> depicts 32.5 ft.,the relief is 7.5 ft. <br /> 5. Conditioned on all Town Department comments read into the record. Including but <br /> not limited to the Board of Health and Conservation comments. If any changes are <br /> made to the plans to satisfy either the Board of Health or the Conservation <br /> Commission, said changes and/or plans shall require the applicant to return to this <br /> Board for review and approval. <br /> 3 <br />
