NEW BUSINESS <br /> 1. Review and approval of meeting minutes: October 29,2020 Regular Session. The minutes were <br /> not yet ready for review and approval <br /> 2. Review and approval of expense warrants. It was understood that expense warrants would have <br /> to be signed outside of the meeting,due to there being no Board members physically present. <br /> 3. Review and approval of Title 5 Variances—12 Sachem Road. Mr. Harrington commented that <br /> the proposed plan for this property was withdrawn by the designer/applicant prior to the <br /> meeting, and was subsequently revised and resubmitted. Two variances are requested to allow <br /> the Soil Absorption System (SAS) to be closer to the street-side property line, and to allow a 4' <br /> separation to the adjusted groundwater. Installation of the new system will necessitate the <br /> removal of the old system in the driveway,and the new system will provide 100%of the required <br /> leaching area. <br /> Raul Lizard!-Rivera, of Cape & Islands Engineering, introduced himself for the record as <br /> representing the applicant. He stated that the previous variance request asked for a reduction of <br /> the leaching area, but they are now prepared to provide 100% of the leaching area. The prior <br /> plans asked for a 7' setback from the street, but that has been adjusted to a 6'setback. The 10' <br /> setback to the garage slab is being held,and the system is over 100'from the wetland. Mr.Lizard! <br /> stated that, based on the 1994 calculations, the required separation to groundwater was being <br /> met but,with the new calculations for Title V, a 4'separation must be provided,which created a <br /> new variance. He informed the Board that the 1994 plan required a 10' strip out and that,once <br /> the existing system is removed, he believed the sand would still be good. He advised Board <br /> members that the existing system is only failed due to distance to groundwater. <br /> Vice-chair Warden stated that she thought the Board only granted a 4' reduction with a <br /> denitrification system, but Mr. Harrington reminded Board members that approval of the 4' <br /> separation has been granted without denitrification many times in Popponesset. Mr. Harrington <br /> also advised the Board that, each year, John's Pond does get slightly higher (he Indicated an <br /> increase of about 2'over the last 20 years),but that is because it Is a controlled pond,not because <br /> of natural groundwater, Ms. Warden stated that, with respect to the 1994 plan, there was not <br /> any real oversight when those systems went in, so there Is no certainty that this system was <br /> installed according to the plan. She asked if there had been any recent soil evaluations,and Mr. <br /> Lizard! answered that there was one at the front of the house. It was not done where the <br /> proposed system would be installed because that is where the existing system is located,and also <br /> where the old test pits were done. <br /> Ms. Warden voiced concerns about the extreme variations in soils between test holes 1 and 2. <br /> Mr. Lizardi stated that,they tried to determine if there was a buried layer of peat when digging <br /> the test pit, but everything was coming up sand. Mr. Harrington verified that there was no peat <br /> in the test hole that was dug closer to the pond. He stated that there were some other low areas <br /> that were probably filled, and indicated that that was likely why they were seeing peat in the <br /> other areas. Ms.Warden argued strongly that a Health Agent should verify the soils at the time <br /> of installation and Mr.Virgilio agreed. <br /> There being no further comments or discussion, Ernest Virgillo moved to approve the Title 5 <br /> variances at 12 Sachem Road, pending a soil evaluation at the time of installation.
