Zoning Board of Appeals Hearing Eligibility. <br /> This Article submitted by the Zoning Board of Appeals seeks voter approval of a recent State <br /> amendment to the provisions governing hearings before the Zoning and Planning Boards. Prior <br /> to this amendment, if a member of the board was absent from a meeting at which testimony was <br /> being given on a case before the board, that member had to be disqualified from voting on the <br /> final determination of the case. Most cases before the board last a meeting or so. In those cases, <br /> a sufficient quorum of the membership would have attended the hearing(s) to vote the board's <br /> decision. <br /> However, if a particular case becomes protracted, as in the case, for example, of the Mashpee <br /> Commons application presently before the Zoning Board, enough members could well have <br /> missed a meeting due to personal or business commitments, which could preclude a final vote <br /> and decision. <br /> This Article would permit members who had missed a meeting to certify in writing that they <br /> have heard or read all testimony presented at the meeting at which they were absent, either by <br /> listening to an audio or video recording of the hearing or by reading the hearing transcript. <br /> Having provided the written certification would continue the member's eligibility to vote on the <br /> ,. case before the board. <br /> THE FINANCE COMMITTEE RECOMMENDS TOWN MEETING APPROVAL OF <br /> ARTICLE 21. <br /> Article 22—31. Planning Amendments. <br /> The Planning Board has submitted 10 articles requesting amendments and/or clarifications to <br /> existing bylaws, as follows: <br /> • Article 22 "grandfathers" lots previously approved by the Planning Board for which <br /> subdivision streets were completed within 8 years of approval of the Board. <br /> 1 • Article 23 would also "grandfather"building lots approved by the Planning Board <br /> under zoning bylaws in-place during the 1970's which allowed cluster subdivisions <br /> without the requirement of a Special Permit. <br /> " • Article 24 updates the storm water management bylaw adopted in 1999 by specifying <br /> additional practices and facilities to reduce nitrogen in runoff and provide additional <br /> design criteria regarding the volume of flows required to be treated. <br /> • Article 25 expands "laboratory and research facility"uses to permit facilities <br /> involved in software development and the assembly of small, hand-held instruments <br /> and devices. <br /> I <br /> 8 <br />
