§84-2 APPLICABILITY <br /> ABILITY <br /> A. No person shall excavate, cut, grade or perform any land-disturbing activities of <br /> significance, without an approved Erosion and Sedimentation Control Plan, except as <br /> specifically exempted herein. Activities subject to this section are those which meet <br /> or exceed the following thresholds. <br /> (1) Any change of existing grade affecting more than 2500 sq.. ft. or 25% of the lot <br /> whichever is smaller; <br /> (2) Removal of existing vegetation from more than 2500 sq. ft. or 25% of the lot <br /> whichever is smaller; or <br /> (3) Storage of more than 100 cubic yards of excavation or fill. <br /> B. Activities which are exempt from the requirement of an approved. Erosion and <br /> Sedimentation Control Plan are as follows: <br /> (1) Construction of a single family dwelling; <br /> (2,) Emergency activities for the protection of life, property or natural resources; <br /> 3 )Existing permitted nursery and/or agricultural operations; <br /> (4) Construction of a new roadway pursuant to approval by the Planning Board under <br /> the Subdivision Control Law; or <br /> (5) Projects with a Storm water Management Plan approved under the provisions of <br /> the Town of Mashpee ZoningBy-law. <br /> C. An emergency activity is defined as an activity required to address an immediate, <br /> unplanned physical threat to persons or property. Examples include, but are not <br /> limited to constructing a firebreak to help contain a wild fire and removing vegetation. <br /> uprooted or dammed by a hurricane. Notification of such activity shall be provided <br /> to the Department of Public Works within 24 hours of the activity being. undertaken. <br /> The requirements of this Bylaw are in addition to any requirement for a permit form <br /> any other local, state or federal regulatory authority, including a permit under the U.S. <br /> Envi.ronmental. Protection Agency's National Pollutant Discharge Elimination System <br /> program. <br /> §84-3 AUTHORITY <br /> The Department of Public Works shall administer implement and enforce this by- <br /> law. <br /> 8 <br />
