Occupancy in a convalescent <br /> home by any patient shall not exceed 30 days within. any calendar year." <br /> "HOSPITAL — An institution licensed by the Commonwealth to provide primary heap <br /> services and medical or surgical care to persons, primarily in.-patients, suffering from illness, <br /> disease, injury, deformity and other abnormal physical or mental conditions. Includes, as an. <br /> integral part of the institution, related facilities such as laboratories, outpatient facilities or <br /> training facilities." <br /> 4) adding the following to Section 174-3 "Required number of spaces" following the listing <br /> for "Apartments built under housing for the elderly": <br /> "Congregate care or 1 per dwelling unit plus one per assisted living facility <br /> employee"; <br /> ) adding the phrase ` , congregate care or assisted living facilities" after the words <br /> "convalescent homes" in the title of Subsection 174-45; <br /> 6) amending Subsection 174-4 .A. to add the following phrase: ", except that such uses maybe <br /> included in a special permit approved under Section 1 74-4 .H." <br /> 7 amending the first sentence of Subsection 174-45.B. to read as follows: "Unless such facility <br /> will be serviced by a public sewer system or a private wastewater treatment plant approved by <br /> the Planning Board and Board of Health wilier is designed to achieve total nitrogen of 5 mg/l or <br /> less in plant effluent, the following land area shall be required for such facilities:""; <br /> adding a new subsection 174-4 . . 3 which reads as follows: <br /> "+ 3 Congregate care or assisted living facility: twenty thousand 0,000) square feet per <br /> dwelling unit plus ten thousand (10,000) square feet for each one hundred ten 110) gallons of <br /> sewage flow, calculated under the provisions of 314 CMR 7.15, as amended, generated by any <br /> other uses on the site."; <br /> 9) adding the phrase "located in the 1' ashpee Center Overlay District or" after the Nord <br /> "Unless" in Subsection 174-4 .C. <br /> 10) replacing the current wording of Subsection 1.74-45, , with the following: <br /> "D. Unless located within the 1 lashpee Center Overlay District, a space not less than fifty (50) <br /> feet in depth shall be maintained as a wooded buffer area in its natural state along each <br /> side, rear and front lot line, except for permitted signs and up to two 2 access driveways <br /> involving clearance of a path no more than forty 4 feet in width and except that said <br /> area may be reduced by a four fifths vote of the planning Board as part of its special <br /> permit decision for such projects when located in the C-1 Commercial District. where <br /> such area is not naturally wooded, it shall be suitably planted with sufficient trees and <br /> understory vegetation, of a type common in natural areas of Mashpee, to replicate a <br /> naturally wooded area and to constitute a visual barrier between the proposed development <br /> and the roadway. Linder no circumstances will parking, retention ponds, or any other <br /> development involving clearance of natural vegetation be permitted within said area. <br />
