Limited, appropriate tree surgery or similar limited maintenance required to protect the <br /> health. of vegetation in this area may be allowed with the approval. of a majority of the <br /> Planning Board. Additional area, plantings, fencing or other items may also be required <br /> by the Planning Board to protect adjacent property owners from adverse impacts of the <br /> project or to protect the character of the neighborhood." <br /> 11) add the following new subsection 174451: <br /> "I. Except within the C-1 zoning district, a minimum of fifty percent (5o% of any site, <br /> which. may include the buffer areas required by Subsection D., shall be left as undisturbed <br /> open space in its natural state,"; <br /> or take any other action relating thereto. <br /> Submitted by the Planning Board <br /> Explanation: This article would allow age-restricted congregate care or assisted living <br /> residential facilities in any residential or commercial zoning district by special permit from the <br /> Planning Board under the same process that currently applies to hotels, motels, hospitals, <br /> infirmaries, nursing homes, convalescent homes and similar uses. It also adds definitions of <br /> those uses, specifies parking requirements, specifies minimum natural buffer areas, specifies <br /> minimum site area for such facilities if they are not serviced by a public sewer system or a <br /> private wastewater treatment plant approved by the Planning Board and Board of Health and <br /> requires that a minimum of 50% of the site be left as undisturbed open space except in the <br /> commercial zone around the Mashpee rotary. <br /> Motion made by Wayne Taylor. <br /> Motion: I move Article 28 be voted as printed in the Warrant, except to amend paragraph 2) to <br /> delete the words "residential and" and the letters "R-Y and "R-5" and with the exception of the <br /> phrase, "or take any other action relating thereto". <br /> Motion made by F. Thomas Fudala to amend. <br /> Motion to amend passes at 9:22 p.m. <br /> Amended motion made by F. Thomas Fudala: I move that Article 28 be further amended by <br /> deleting the words "C-2 and C-3 in paragraph 2) and replacing them with the words "and C-2", <br /> by changing the number of the new subsection described in item 8) from "subsection 174- <br /> 45.B.(3)" to "subsection 174-45.B.(4)" and by correcting the printed text of item 4) so that the <br /> words "Congregate care or I per dwelling unit plus one per assisted living facility employee" <br /> read as follows: <br /> Congregate Care or I per dwelling unit plus I per assisted living facility employee <br /> Planning Board voted at a Public Hearing held September 6, 2000 4-0 for approval. <br /> Amended motion passes unanimously at 9:30 p.m. <br />
