Article 23 <br /> To see if the Town will vote to amend the zoning bylaw as follows: <br /> Replace the current wording of Subsection 174-26.B.(1) with the following: <br /> Notwithstanding the provisions of Subsection A, within any year the number of new <br /> dwelling units for which building permits may be issued shall not exceed 100. Said <br /> total shall not include any dwelling units exempted from the provisions of this section <br /> by Subsection C. below." <br /> Amend Subsection 174-26.C.(1) by replacing the phrase "Subsection A" in the first <br /> sentence with the phrase "this section" and adding after the phrase "developments <br /> approved prior to May 11, 1987, under an unexpired special permit which included a <br /> specific annual phasing schedule," in the first sentence the phrase "dwellings legally <br /> restricted to occupancy by persons aged 55 or over in conformance with Massachusetts <br /> General Laws and applicable regulations," <br /> with said amendments to take effect on January 1, 2000, <br /> or take any other action relating thereto. <br /> Submitted by Planning Board <br /> Explanation: This article would reduce the number of building permits which may be <br /> issued annually from 2 1/2 % of existing building stock (approximately 200 units in <br /> 1999) to 100, excluding permits for building within Open Space Incentive Development <br /> projects, projects legally restricted to occupancy by persons aged 55 or over, public <br /> housing developed by the Mashpee Housing Authority, up to 100 units of deed- <br /> restricted low- or moderate-income housing as defined by the Mass. Department of <br /> Housing and Community Development and projects that are exempted from this bylaw <br /> provision by the "grandfather" clause contained in the state Zoning Act. In 1998 there <br /> were 293 residential building permits issued in Mashpee, of which 178 were determined <br /> by the Building Inspector to be exempt from this bylaw by the state "grandfather" <br /> clause. <br /> Motion made by Selectman Taylor. <br /> Motion: I move Article 23 be approved as printed in the warrant with the exception of <br /> the phrase, "or take any other action relating thereto." <br /> Planning Board voted at a Public Hearing held August 18, 1999 4-0 for approval. <br /> Motion made to consider Articles 23 and 35 together at 9:31 p.m. <br /> Motion to amend passes at 9:47 p.m. <br />
