MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> TUESDAY,FEBRUARY 2,2021 <br /> Chairman Furbush went through the items he submitted to the Board on January 27,2021. <br /> Ilana confirmed receipt of the letter from Clay Nicholson that the name of the new location <br /> is Cooper Street. <br /> Chairman Furbush mentioned he spoke with Andy Marks, with Mashpee Water <br /> Department. He said a condition should be added to the decision for final approval from <br /> Mashpee Water Department. <br /> Ilana said that the water connection if granted by the ZBA under 40B is subject to <br /> confirmation referral by the Mashpee Water District for determination of full compliance <br /> of technical requirements that apply. <br /> Chairman Furbush asked about the item regarding the surety of Cooper Street. <br /> Ilana said that a change would be to remove the letter of credit as an option for surety to <br /> avoid letters of credit in this situation. <br /> Chairman Furbush wanted an understanding regarding procedure 760 CMR 56.05 (11). <br /> Ilana explained that if this language is added, there will be a roadmap for people in the <br /> event that a modification is needed. <br /> Chairman Furbush wanted clarification regarding Item 4. Page W. <br /> Ilana explained that 99.9% of the time the projects will not comply with the density <br /> requirements that apply under the zoning bylaw. There's a waiver request under the <br /> application so that the provision under the zoning bylaw that the project needs to be <br /> constructed in accordance with the plans,and that there is no intention to reduce the density <br /> by requiring full compliance with this particular provision. <br /> Charlie Rowley said this item makes sense and will make it easier for the Building <br /> Inspector to issue the permit. <br /> Mr. Furbush wanted to confirm that a performance bond will be posted. Charlie Rowley <br /> said there was an agreement that the applicant will take care of any damage to Cooper <br /> Street. <br /> Ilana confirmed that the petitioner shall be required to repair any damages to the existing <br /> portion of Cooper Street. <br /> The Architect will confirm the height of the largest building. He confirmed that the height <br /> of building from the average grade is 31.4 ft. <br /> Charlie Rowley confirmed the parking lot aisle width to be reduced from 24 ft.to 20 ft. <br /> 3 <br /> F <br />
