MASRPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> TUESDAY,FEBRUARY 2,2021 <br /> Charlie asked the Architect if the measurement was measured to the mid-point and not the <br /> peak. <br /> Charlie Rowley said that the road covenant needs to be released in order to clear the public <br /> record. The question is how to secure the construction beyond Cooper Street where the <br /> trenching will take place for the water main. Typically under the subdivision rules and <br /> regulations you have to release the lot once you provide the security, or construct the road. <br /> Ilana asked that the ZBA shall act as the Planning Board and release the covenant as <br /> appropriate and to post surety at the time as noted under Item 2 page 5, in the Decision. <br /> Charlie wanted to make sure that the language is revised to reflect that the surety would be <br /> released before any building occupancy can take place.He suggested that when the project <br /> goes out to bid,that there will be numbers that reflect the cost of the road construction,and <br /> the utilities within Cooper Street. <br /> Mr. Furbush wanted to make sure that this process can be done on a later date. <br /> Rana confirmed that the Board of Health requirements are documented in the decision. <br /> Ilana confirmed that the Fire Chief was satisfied.There was no change to the Architectural <br /> Plans. <br /> Ilana revised the condition regarding the raised crosswalks to state just one of the <br /> crosswalks is raised. <br /> Ilana said once the public hearing is closed there can be no new information. The only <br /> changes will be clerical. <br /> Chairman Furbush polled the members for comments. Mr. Gould reminded the Board that <br /> this 40B project must remain in perpetuity. Ilana mentioned that the clause is noted on Page <br /> 4,Item 15. <br /> Dave Morris mentioned how impressed he was with the Board and applicants for all their <br /> hard work. <br /> Rosaleen Cassidy, with South Cape Resort spoke and was satisfied with the Board's <br /> involvement to help solve her concerns regarding the impact during and after construction <br /> as well as the safety of her residents and employees. The Board requested the applicant <br /> install a speed table cross walk, and provide additional buffering along the two properties. <br /> There is also imposed conditions regarding time scheduling during construction. <br /> Rana read the specific construction dates and time scheduling that was included in the <br /> decision. <br /> 4 <br /> I <br /> f <br /> t <br />
