If vehicles are brought into the building, the plumbing inspector may <br /> require floor drains, in which case, an industrial tight tank would be required. Mr. Morra said that <br /> there are no interior changes, and there is currently only one employee. <br /> Evan Lehrer, Town Planner: <br /> Evan asked Mr. Morra if the property is currently being utilized as an auto body repair, with a spray <br /> booth operation as indicated in the application. Mr. Morra said that the spray booth is not being used. <br /> He said Mr. Bugg uses the booth for spark repair, but not vehicles. <br /> Evan explained the benefit of coming to the Town, and to the Plan Review Committee prior to <br /> commencing operations is so the Committee can communicate and identify what the code <br /> compliance issues are that need to be managed and mitigated prior to operating the business, and <br /> to determine any investments required that will not cause any issues later. For example; if the <br /> plumbing inspector requires floor drains,the floor may need to be torn out. Also, the Fire Department <br /> requires a sprinkler system in the spray booth. There are a number of other code compliance issues <br /> that will need to be managed and mitigated prior to the business continuing operations in that building. <br /> Evan said that the building permit is for the construction of the spray booth only, not the use. The <br /> ZBA or the relative permit granting authority did not issue a modification to the Special Permit. The <br /> Plan Review application does not include the uses of automotive repair as well or the spray booth, <br /> and does not allow this activity at this time regardless of the issuance of the building permit. Evan <br /> said he is not prepared to make a recommendation to the Board of Appeals at this time considering <br /> all the code compliance issues that need to be rectified. <br /> As Deputy Phelan mentioned, continuing to utilize the property without the benefit of the appropriate <br /> permits and reviews by the granting permitting authorities would be detrimental.The Fire Department, <br /> Building Department, and the Board of Health have significant issues to address with the property <br /> owner before the uses of the application are laid out. The Committee needs to discuss some type of <br /> plan, and the applicant needs to produce actual drawings and comprehensive plan sets for actual <br /> review before consideration to the Board of Appeals. <br /> Evan said the use is allowed under the Zoning Bylaw, but there are a number of investments that <br /> need to occur inside the building to accommodate the uses that are proposed. Moving forward from <br /> today onward, he doesn't believe that operations should continue inside the building until <br /> appropriately permitted, and that the changes are made. <br /> The Committee wants to help the applicant get to a point so you can go to the Board of Appeals <br /> confidently with recommendations and make some decisions. Evan said he is not going to make any <br /> recommendations today. A conversation among the department heads to discuss the code <br /> compliance issues, and that the operations should cease until there are some consensus on how to <br /> proceed, and then the applicant can return to the Plan Review committee with a more comprehensive <br /> set of plans that the committee can respond to. <br /> Christine Willander, Assistant Health Agent: <br /> It is the plumbing inspector who makes the determination about the need for the floor drains. <br /> 2 <br />
