3 <br /> Minutes <br /> March 22, 2021 <br /> APPOINTMENTS&HEARINGS <br /> Discussion and Approval of the request of Mashpee Commons Limited Partnership, Arnold Chace, <br /> Jr., Mashpee Commons II, LLC, and GNRS-MA LLC that the Town of Mashpee join as a <br /> "Participating Party"in a Three-Party Development Agreement with the Cape Cod Commission for <br /> the Proposed Expansion of Mashpee Commons: (continued) <br /> The Cape Cod Commission was noted to have voted on March 4, 2021 to participate as a <br /> "Participating Party" in the Three-Party Development Agreement for the proposed expansion of <br /> Mashpee Commons an area encompassing approximately 187 contiguous acres for mixed-use <br /> development and open space. <br /> The project involves a wide range of processes and terms to be agreed upon including municipal <br /> dialogue and processes. The Town of Mashpee recently submitted a letter of support, and this <br /> Agreement would affirm the Town's willingness to commit to the project. This is the first Three- <br /> Party Agreement in the Cape region. With the Select Board's approval the process would advance <br /> forward with various discussions and agreements. <br /> Of note is the Town of Mashpee Zoning Bylaw which limits development agreements to (10) <br /> years. Attorney Cox indicated when the Cape Cod Commission is not a part of a development <br /> agreement, the term cannot exceed 10 years. With the Cape Cod Commission serving as an <br /> appropriate party to the Agreement, the 10-year time frame would not be applicable. <br /> The Select Board was receptive to the invitation to participate as a"Participating Party"to the Three- <br /> Party; 25-Year Development Agreement with clarification of the statute. <br /> Motion made by Selectman Gottlieb for the Town of Mashpee to participate as a"Participating <br /> Party" with the Cape Cod Commission for the proposed expansion of Mashpee Commons. <br /> Motion seconded by Selectman O'Hara. <br /> VOTE: Unanimous. 5-0. <br /> Roll Call Vote: <br /> Selectman Cotton, yes Selectman O'Hara, yes Selectman Sherman, yes <br /> Selectman Gottlieb, yes Selectman Weeden, yes Opposed, none <br /> Board of Selectmen <br /> Minutes <br /> March 22, 2021 <br />
