The owner has indicated her intention to <br /> appeal the fine. <br /> NEW BUSINESS <br /> 1. Review and approval of meeting minutes, The minutes of the January 7, 2021 meeting were <br /> reviewed with no changes. Ms.Warden was not present for that meeting. <br /> There being no further comments or revisions, Ernest Virgilio moved to accept the minutes of the <br /> December 7.2021 public session meeting. Motion seconded by Brian Baumgaertel. Roll call vote: <br /> Ernest Virgilio (yes);Veronica Warden (abstain); Brian Baumgaertel (yes). VOTE: Unanimous (2- <br /> 0-1). <br /> 2. S*ign expense warrants. It was understood that expense warrants would have to be signed <br /> outside of the meeting, due to there being no Board members physically present. <br /> 3. Rev*lew of tobacco violations — Commons Convenience,, 414 Nathan Ell'is Highway. Mr. <br /> Harrington commented that this item was added to the agenda for the purpose of reviewing a <br /> tobacco violation at Commons Convenience., 414 Nathan Ellis Highway. Bob Collett of the <br /> Regional Tobacco Control Commission performed an inspection on December 2, 2020 which <br /> identified Fronto products that were considered blunt wraps. Selling blunt wraps are a violation <br /> of the Board of Health Tobacco Sales Regulation. <br /> The letter to the owner of the establishment, dated December 11, 2020, stated that there were <br /> two sets of violations to be reviewed. Mr. Harrington recently came to notice that the violation <br /> of December 2,, 2020 is a first, stand-alone violation, based on the fact that the violation of <br /> October 3, 2019 had been waived and the violation of April 16, 2016 was outside the four-year <br /> tolling period. Mr. Harrington stated that a $100 fine is all that should be issued, and he will <br /> prepare a new fine letter. <br /> 4. Review and approval of Nitrogen Aggregation Plan—Cape&Islands Engineerling,,21 Menemsha <br /> Road. Mr. Harrington commented that a nitrogen aggregation plan was being requested for 21 <br /> Menemsha Road, located in Popponesset, north of Deans Pond. The open space area in the <br /> Seabrook Village subdivision is to be used as credit land for the undersized property to obtain the <br /> additional land for more bedrooms. In this case, 16,,000 SF are being utilized to obtain the 24,000 <br /> 5F required area for three bedrooms,with the aid of a denitrification unit. The credit land survey <br /> plan and Grants of Title V Nitrogen Loading Restriction and Easement for the facility and credit <br /> land have been provided. The $250 review fee has been paid. The plans and documents have <br /> been reviewed. The second paragraph of the facility land restriction and easement needs to be <br /> revised. The credit land restriction and easement was correct. The septic design plans have not <br /> been submitted with this approval request. <br /> 0 <br /> Matthew Costa,,of Cape&Islands Engineering,introduced himself for the record. Hecommented <br /> that this is an existing one-bedroom home that utilizes a FAST system. He corrected Mr. <br /> Harrington's earlier comment,. stating that the credit land is off of Leather Leaf Lane, not in the <br /> Seabrook Village subdivision. He further stated that they were proposing to add more chambers <br /> to increase the leach field size,and keep the existing denitrification system in place. Ms.Warden <br /> 3 <br />
