Mr. Harrington advised the <br /> Board that Mr.Labute was not given notice of this discussion. He commented that a septic system <br /> was installed by Mr. Labute in August 2018, at 425 Great Neck Road North. A septic inspection <br /> ►ryas performed by Doug Brown on November 16,, 2020. The inspection report referenced the <br /> detail that went into locating the distribution box. Mr.Brown had to follow the line from the tank, <br /> as the as-built prepared by Mr. Labute was nine feet off. Additionally,it was discovered that there <br /> was no riser on the d-box. The file indicates that the over-dig on the original installation was two <br /> feet short and the installer was charged an extra $25 fee for a second 'Inspection by a Health <br /> Agent. Mr. Harrington read from Mr. Brown's inspection report,which indicated that the as-built <br /> sketch by Mr. Labute was completely inaccurate. In Mr. Harrington's opinion, the issues <br /> encountered at this property during the inspection were the direct result of Mr. Labute's as-built. <br /> All errors were corrected by Mr. Brown in his report sketch. <br /> Ms. Warden asked for some history on the installer, and Mr. Harrington stated that Mr. Labute's <br /> license is current, but he has been brought before the Board on at least three other occasions, <br /> including a situation where he installed a leach trench off property. Chair Baumgaertel noted that <br /> Mr. Labute's as-built sketch reflected a substantial deviation from the actual location. Ms. <br /> Warden asked if Mr. Harrington had indicated on the original inspection card that there was a <br /> riser present, and Mr. Harrington answered that he did not, but that there were risers noted on <br /> the tank. <br /> Ms. Warden was of the opinion that, because Mr. Labute has been before the Board multiple <br /> times, this situation needed to be addressed. She suggested that Mr. Labute would pay closer <br /> attention to these details if a fine is imposed, and Chair Baumgaertel agreed, stating that Mr. <br /> Labute can either pay the fine and learn a lesson, or come before the Board to show cause why <br /> the fine should be waived. <br /> There being no further comments or discussion,, Veronica Warden moved to issue a fine of$100 <br /> to Michael Labute for failure to submit a correct as-built and failure to install a riser on the d-box. <br /> Motion seconded by Ernest Virgilio. Mr. Harrington <br /> commented that the October 2020 Groundwater Monitoring Report was submitted to the Board <br /> of Health for review and approval prior to submitting to DEP. Mike Martin, of Tighe & Bond, <br /> informed the office that a third party had submitted a request for information to DEP regarding <br /> last year's groundwater monitoring reports. Mr. Martin stated that, in the Central Region, this <br /> request for information led to the requirement for PEAS testing of the groundwater monitoring <br /> wells at the landfills.
