MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> JULY 247 2019 <br /> Bill Blaisdell wanted to know the concerns of the cut-through. Matt said there's the <br /> possibility that people will drive through to avoid the traffic light to cut through the parking <br /> lot. <br /> Jonathan also mentioned the concerns discussed by the Fire Department which were stated <br /> in the motion by the Plan Review committee. <br /> Attorney Kirrane is willing to continue this hearing so they can bring a revised landscape <br /> plan, and will have a conversation with the Fire Chief. <br /> Sharon read the DPW, Board of Health, and Conservation comments into the record <br /> submitted to the Zoning Board. Sharon read a letter submitted on July 24,2019 by Stephen <br /> Carroll,Rockland Trust. <br /> Jonathan invited comments by the audience. <br /> George Boiros, Vice Chairman of the Board of Trustees for Shellback Way Residences <br /> approached the Board, and said he is not in opposition of the project, however he wanted <br /> to discuss the concerns that the Board had already discussed such as the traffic concerns,the entrance/exit, and the State permitting..He mentioned the easement road that's being <br /> discussed which is located on the lower end of Shellback Way. He said Shellback Way is <br /> a private road as it enters their property, and there's a lot of confusion whether the area <br /> from Rte. 28 to their entrance is private or public. He said they secured a condo lawyer to <br /> settle the issue of road ownership.He said there's a lot of congestion and traffic exiting the <br /> bank, exiting the marketplace, and concerns about the Rockland Trust area. He asked the <br /> Board if they could supply the homeowners with a site plan. <br /> Ron asked Mr.Boiros what the attorney has done to look into the situation.Mr.Boiros said <br /> he has gone to the Barnstable Registry of Deeds, has reviewed Town records, spoke with <br /> the Town Planner,and there seems to be conflicting data on the ownership of the road.Ron <br /> asked if the attorney could give the Board some input on his research. Mr. Boiros said he <br /> will discuss with the attorney. <br /> Ms. Sally Bold,a resident of Shellback Way has been a member over 30 years. She asked <br /> the Board who allows a commercial entity the right to develop on a private road. She said <br /> she is not aware of any written agreements granting permission to any of the commercial <br /> stores, and buildings that are on the private road.
