MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> JULY 24,2019 <br /> Mark Hammond,a resident of Shellback Way asked if the State denies egress from Rte. 28 <br /> to the property is there a contingency plan,and/or will the applicant continue with this plan <br /> if the State does not grant permission. <br /> Jon said it will not be approved until that matter is settled. A new plan would need to be <br /> submitted, and a meeting with Plan Review, and the Zoning Board would be required. <br /> Diane Cannistraro, 160 Shellback Way said that lower Shellback Way is very congested <br /> and she is concerned with traffic flow. She wanted to know why would there be another <br /> building constructed when there is an existing industrial area. She would like the Board to <br /> reconsider this project. <br /> John Miller, 144 Shellback Way,wanted clarification regarding the entrance and exit onto <br /> Rte. 28.He asked if there could be an entrance from Jobs Fishing Road. He asked that the <br /> applicant consider to mitigate the access off of Jobs Fishing. He said that there are two <br /> addresses numbered 9 Shellback Way, and the letter is sometimes omitted. He also asked <br /> if it would be possible for the applicants to create a contractual agreement to help fund the <br /> .costs of maintaining the road, unless at Town Meeting would be considered taking that <br /> portion of Shellback Way for the Town to maintain the road. - <br /> Ron asked Attorney Kirrane if there is access through the easement from the back of the <br /> proposed property. Attorney Kirrane has not done a title search on this particular property. <br /> Matt said that their property has legal frontage on Shellback Way. <br /> Ron said the question is who has the ownership of Shellback Way. <br /> There were no more comments from the audience. <br /> Ron made a motion to accept the applicants request to continue both hearings until August <br /> 28,2019.Mr. Blaisdell second. All were in favor. <br /> Attorney Kirrane requested a copy of all the letters, and the minutes from the various <br /> committees. <br /> 413 Nathan Ellis Highway (Route 151): Petitioner, Industria Development Group, Inc. <br /> requests a Special Permit under §174-24, and §174-25 E (1)to allow for construction of a <br /> 9,915 sq. ft. retail use commercial building together with accessory parking on property <br /> located in a C-2 Zoning District, (Map 72 Parcel 56A),Mashpee, MA.
