<br /> At the last hearing, Attorney Kirrane mentioned that there is a topographical situation
<br /> with the businesses along Rte. 28 and Rte. 151, who are at a competitive disadvantage
<br /> which he suggested would be a hardship.Retaining some of the natural state buffer of scrub
<br /> pines, and underbrush and supplementing the landscaping that is natural to the Cape Cod
<br /> area is far more attractive to the eye than just scrub pine and underbrush. The revised
<br /> landscape plan depicted the larger trees that will remain in front of the property, and the
<br /> applicant is seeking the opportunity to manage the understory that is in the buffer area. The
<br /> plan also shows the improved landscaping surrounding the proposed building.
<br /> Chairman Furbush reviewed the minutes regarding the natural buffer that were
<br /> discussed at the Design Review on May 21, 2019, and the ZBA meeting on July 24, 2019.
<br /> He asked Matt Costa how much of the natural buffer will be remaining. Matt said that it
<br /> will be approximately 35 ft. from the property line, and will be lined with the plantings.
<br /> There will be 21 trees remaining. He said the trees that he is removing range from scrubs
<br /> to 1 to 2 inches in size. Matt said that he did not specify the names of the plants at Design
<br /> Review,but the new plan submitted to the ZBA does include the planting names. Jonathan
<br /> asked about the drainage. Matt said that the runoff water will be captured at the property
<br /> line, and it will be managed on site. The areas within the layout that will be managed by
<br /> DOT, and when received will be tied into their system.
<br /> There were no more comments from the Board or audience.
<br /> In view of the foregoing, the Board determined the Petitioner met the criteria for a
<br /> Variance. Upon motion duly made and seconded at the Public Hearings on Wednesday,
<br /> August 28, 2019,the Zoning Board of Appeals voted unanimously to issue a Variance for
<br /> 9 Shellback Way, Petitioner, Bridgestone Development, Inc. under §174-31 FN. 14
<br /> (natural state buffer), to allow for construction of a 9,801 sq. ft. commercial building and
<br /> accessory parking to be used for professional and medical office uses on property located
<br /> in a C-1 Zoning District, (Map 81 Parcel 132), Mashpee, MA. (Owner of record: Faith J.
<br /> Baptiste, Trustee of the Cushman Brownie Trust) with the following conditions;
<br /> 1. The Board has determined that the applicant meets all the conditions of a Variance
<br /> under Mass General Law 40A Section 10.
