The Board agreed that the fines were within the guidelines of similar properties with the <br /> same issues. The Board agreed to wait until the previous owners had received the <br /> certified letter, and to continue the matter to the next meeting. <br /> There being no further comments or discussion, Kripani Patel moved to continue the <br /> show cause hearing for 257 Monomoscoy Road until owners receive the certified letter. <br /> Motion seconded by Ernest Virgilio. Roll call vote: Ernest Virgilio(yes); Kripani Patel (yes); <br /> Brian Baumgaertel (yes). VOTE: Unanimous (3-0). <br /> 4. Review of correspondence from Southport Cape Cod. Mr. Harrington explained that <br /> Southport wanted to notify the Board of Health that they made a government relations <br /> committee. This is just a notice. They have not reached out to the Board of Health other <br /> than sending the correspondence. Mr. Harrington explained that we have already <br /> inspected their swimming pool and that they have not had any issues. Chair Baumgaertel <br /> thought it was great that they created this committee. <br /> 5. Opt-Out of Mosquito Spraying. Mr. Harrington commented the State Reclamation and <br /> Mosquito Control Board has requested that each town make a decision whether it wants <br /> to allow wide aerial spraying for mosquitos if the situation demands it. If the Town <br /> chooses not to spray or to "opt-out," a plan must be provided. The Select Board of each <br /> town must make the decision, and the Mashpee Selectmen have asked the Board to issue <br /> a recommendation/opinion on the matter. <br /> Mr. Harrington recommended that the Board vote not to opt-out of any of the options <br /> provided by the Mosquito Control Board. He stated that,to his knowledge, Mash pee has <br /> not required spraying of any kind in the past, he does not want to limit our response. <br /> Falmouth had spraying from a truck for certain neighborhoods last year, including Main <br /> Street. Private homeowners do have the option to not have their property sprayed by <br /> submitting an opt-out/exclusion. <br /> There being no further comments or discussion, Kripani Patel moved to not opt-out of <br /> any of the options provided by the Mosquito Control Board. Motion seconded by Ernest <br /> Virgilio. Roll call vote: Ernest Virgilio (yes); Kripani Patel (yes); Brian Baumgaertel (yes). <br /> VOTE: Unanimous (3-0). <br /> OLD BUSINESS <br /> 1. Review of request for Food Code variance — 17 Steeple Street. Mr. Harrington <br /> commented that Graham Silliman, from Siena, informed him that he had found a heater <br /> that was applicable to their situation,so they have withdrawn their request for a variance. <br /> No further action was required. <br /> 2. Review of compliance—545 Cotuit Road. Chair Baumgaertel noted that the owner, Ms. <br /> DeTanya Rezendes, was not on the Zoom call. Mr. Harrington informed the Board that <br /> he had emailed the Zoom meeting information to the owner. He previously emailed her <br /> 2 <br />
