Joyce <br /> requesting a Written Finding under§174-17 of the Zoning Bylaws to replace a pre-existing <br /> pergola structure with a roofed pavilion on property located in an R-3 Zoning District, at <br /> 78 Popponesset Island Road, Map 106 Parcel 30, Mashpee, MA. (Continued from March <br /> 11, 2020 hearings at the request of the applicant). <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter <br /> 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee,on March 27,2020 and April 3,2020 a copy of which <br /> is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held virtually and remotely on the Petition at the Mashpee Town Hall <br /> on Wednesday, April 22, 2020 at which time the following members of the Board of <br /> Appeals were present and acting throughout;Chairman,Jonathan Furbush,Vice Chairman, <br /> William Blaisdell, Board Members, Ron Bonvie, Scott Goldstein, and Norman J. Gould. <br /> Also present was Charlie Maintanis, Building Inspector. <br /> Attorney, Andrew Singer and Sean Riley with Coastal Engineering were present. At the <br /> last hearing,the Board requested a revised site plan depicting that there was no increase in <br /> lot coverage (existing lot coverage is 33.5%). Mr. Singer said he provided a revised site <br /> plan dated April 7, 2020 with the requested revisions. He said that the Conservation <br /> Commission approved the project, and Mr. Riley spoke to the Health Agent and discussed <br /> some concerns. Mr. Singer requested that the Board could impose a condition that the <br /> Health Agent has signed off on the upgrades to the septic system prior to construction. <br /> The site plan depicted the decrease in lot coverage from 37.5% reduced to 33.5% lot <br /> coverage. <br /> 1 <br />
