MASHPEE ZONING BOARD OF APPEALS <br />MEETING MINUTES <br />OCTOBER 13, 2021 <br />Mr. Weishaus represented himself for the proposed project. He mentioned there was an <br />error in the building plans from the architect regarding a fourth bedroom. It was a <br />misunderstanding and there is no intention for a fourth bedroom. <br />Sharon read the Board of Health comments into the record stating that the septic is <br />restricted to three bedrooms. The Conservation comments stated that the project is out of <br />wetlands jurisdiction. <br />The Board had a discussion about the setbacks on the property. The plan depicted an <br />existing setback of 35.14 ft. from the front, and the proposed is 29.26 ft. The Board needs <br />to determine if the proposed is more detrimental than what exists. <br />The Board reviewed the building plans and had a discussion regarding the concerns with <br />the Board of Health. <br />Dave said that the Board does not need to be concerned about the issue with the building <br />plans because they will have to be reviewed during the permitting process. <br />Chris suggested that the Board can approve the Written Finding which can be granted <br />without the building plans. The building plans will be submitted to the Building <br />Commissioner and will require a 6 ft. opening to the additional room. <br />Mr. Bonvie made a motion that the Board issue a Written Finding to Owners, Richard J. <br />and Janet E. Weishaus request a Written Finding under §174-17 of the Zoning Bylaws to <br />allow for an addition, extension of a pre-existing non -conforming single family dwelling <br />on property located in an R-3 Zoning District, Map 116 Parcel 9, Mashpee, MA with the <br />following conditions; <br />1. The Board has determined that the applicant meets all the conditions of a Written <br />Finding under Mass General Law 40A Section 6. <br />2. Certified Plot Plan — 49 Fells Pond Road, Date: 8/25/2021, Scale: 1" = 20', Drawn <br />by: RBS, Job No.: S795, DWG. CPP, Revised: 9/2/2021, Lot Coverage, Proposed <br />Lot Coverage: 14.5%, Prepared by: Robb Sykes, P.L.S., No. 35418 Registered <br />Land Surveyor, Date: 9/2/2021, Eastbound Land Surveying, Inc. <br />3. Conditioned on all Town Department comments read into the record including but <br />not limited to the Board of Health. The applicant shall revise his building plan to <br />reduce his bedroom count to three as outlined by Board of Health comments read <br />into the record, and that the plan approved by the Board of Health meets their <br />regulations as a three bedroom residence. <br />F <br />
