They would like to define it to say that when construction is <br /> started, if a facility is available and the municipal <br /> authority will allow them to connect, they will connect <br /> (Pg. 8 condition 6) <br /> Tony asked if start construction means construction of <br /> their treatment plant? <br /> Mr. Dittami said it did. <br /> r: <br /> 2 . The wording regarding number of permits and disposition <br /> of phases 3 & 5 (pg. 13 condition 12) . Mr. Dittami <br /> explained that if phases are going to be available for <br /> future use, they would like to have co-discretion with the <br /> Hoard for additional construction. <br /> They would like to change from 18 month to 6 month time <br /> period from when the permit is a t pproved to when they can <br /> bring the issue before the Board again. <br /> Forward Development would like to be the initiating force <br /> behind who brings issue to the Board because it will have a <br /> direct affect on their development. <br /> Tom asked why should Forward have control over the State' s <br /> property? <br /> Mr. Dittami stated it's not the State's property so much as <br /> the permit. He believes Forward should have first option to <br /> exercise those permits and full utilization of all available <br /> permits underneath this Special Permit. The State has <br /> bought the rights but not the permits. <br /> 3 . Connection to Whiting's Road through their development ' <br /> (pg 16 condition 24) . They will accept the condition with ' <br /> the provision that access will only be opened up if <br /> Whiting's Road is built from Rte 28 northward to where their <br /> . r <br /> connection will be. When Whitings Road is finished this <br /> condition will start. If the Board would like to limit <br /> the connection as an egress for the subdivision and access <br /> for town vehicle's, they would have no objections. <br /> Tom said that even with and egress they will have other j <br /> people traveling through the subdivision. <br /> Mr. Dittami stated that this becomes a problem for the Condo <br /> Association, and they will have the ability to limit it <br /> since it will be a private road. <br /> 4. Payment of $600,000 (pg. 7 finding 9C) . The initial <br /> agreement with the Town is for 6 months from date of <br /> compliance with provisions 6 through 11 of agreement <br /> (including permit for waste water treatment facility) . 1 <br /> Judy stated that the Water District is waiting for the <br /> $600 , 000 to start development of the well to service their <br /> subdivision and until they get it they will not work on <br /> well . <br /> Tony stated they will talk about modifying language in the <br /> last sentence. <br /> - 10 <br />
